Lawsuit Claims Obama Constitutionally Ineligible for the Presidency

I think it's a work of art. It takes all those rumor emails about Obama and wraps them up into one neat little lawsuit. The point is to enjoin Obama and the DNC from going through with his nomination next week. Why now?

"I filed this action at this time," Berg stated, "to avoid the obvious problems that will occur when the Republican Party raises these issues after Obama is nominated."

That is getting so familiar.

The lawyer who sued is Philip J. Berg, certified nutcase. He's a Clinton supporter, former gubernatorial and senatorial candidate, former chair of the Democratic Party in Montgomery (PA) County, former member of the Democratic State Committee, and former Deputy Attorney General of Pennsylvania. He's also a Truther. Like all Truthers, he falls for the simplest of tricks. For example, he cites Wikipedia for some of his claims.

Added: In case I didn't make that clear above, I think the lawsuit should be laughed out of court. The rumormongering about whether Obama is really enough of an American to run for president is pretty silly. As are the whispers about whether McCain counts as a "natural born" citizen.

Later: Okay, the documents related to this case are here (thanks to Penfold). If this is the caliber and tone of his previous lawsuits, it's a miracle he hasn't been smacked with sanctions yet. Even if his allegations are true, this is not an example of good lawyering.

2 That Texas Darlin person is a piece of work. I think it's too bad she can't be sued for every penny she has and utterly destroyed financially with her reputation ruined. She deserves it.

5 [Obama is really enough of an American to run for president][McCain counts as a "natural born" citizen."] Ok Gabe, but the "natural born" citizen thing in the Constitution won't be much of a restriction if Everyone on the fricken planet is a Natural Born Citizen.... and the courts seem to be heading in that direction. I think we should tighten up the definition of citizen, not loosen it. I'm sick of the anchor baby thing in particular. And does anyone really think Aaaanold should be able to be president?

6 This is hilarious.  "Before Republicans raise them."  Like McCain would want to run against anybody else BUT Obama.  The Democrat this time should be walking away with this thing, and that's even without taking into account the fact that many conservatives can't stand McCain.  Obama might still win, but he's a freakishly weak candidate, and the idea that Republicans want to prove him ineligable for the office so that they can run against a stronger candidate (like pretty much anyone else) is ludicrous.

12 Heh, i sent Ace an e-mail about this. Has anyone seen the complaint itself or the TRO application. I have not read it. Though I can confirm it was filed (PACER, but my firm would give me the evil eye if i spent more than a few cents on this). Someone on TexasDarlin pointed out the various ways a person can be a "natural citizen". I don't know if they were right, but the list was fairly expansive and if they were right, Berg is about to discover the joys of Rule 11 sanctions.

Should be interesting to see if Berg can serve BHO before the Convention. I think it's amusing that the dems are tearing themselves apart in what should have been an easy win.
