Canadian Court Overturns... Parent's Grounding of Child for Posting "Inappropriate" Pictures of Herself the Internet
— Ace

The dad wouldn't allow her on a school trip after she repeatedly went to chat sites he had blocked her from using. And posted "inappropriate" pictures of herself.

Seems reasonable.

But a Canadian court reversed his decision:

The girl had taken her father to Quebec Superior Court after he refused to allow her to go on a school trip for chatting on websites he tried to block, and then posting "inappropriate" pictures of herself online using a friend's computer.

The father's lawyer Kim Beaudoin said the disciplinary measures were for the girl's "own protection" and is appealing the ruling.

"She's a child," Beaudoin told AFP. "At her age, children test their limits and it's up to their parents to set boundaries."

...

According to court documents, the girl's Internet transgression was just the latest in a string of broken house rules. Even so, Justice Suzanne Tessier found her punishment too severe.

"Now, if she had been posting excerpts from Mark Steyn's America Alone, I might have authorized involuntary psychiatric hospitalization," the judge allowed.

I made that last part up, but it's pretty much true.

Jesus. Candad's gone. It's gone, MacReady.

Now, this little whore was obviously chatting sexually with men (or at least boys) and posting sexualized pictures of herself. The dad tried to stop her; she wouldn't.

A judge stepped in to basically protect her fundamental right to be sexually violated by an adult.

I think child molesters get the message that Canada is "cool" with their lifestyle choices.

Ah: Maetenloch provides some crucial background:

The parents have been embroiled in a custody suit for years, and it appears the mother prompted the daughter to file the suit against her father.

After the ruling the father declined to take custody of the daughter back, saying he no longer had any control over her.

Longer Piece: with more on the Kramer-vs.-Kramer wrangling.

Fact is, the school's policy required permission from both parents. The father refused his, citing her consistently sneaking on to the internet against his wishes. The court claims the "context" is "complex," but the court stepped in and signed the permission slip on the father's behalf, basically.

Because a school trip was a "once in a lifetime" "rite of passage" and so was "exceptional."

She just graduated from elementary school.

1 Sounds like a simple solution would be to let her figure out how to pay for a computer and internet access without her parents help.

2 Time for her parents to shut off the family internet services and cut off any money behind paying for absolute necessities. This child is already a spoiled little brat

as maetenloch says this is deeper than the intial report posted here.

the father has full custody and this smells like mom and the girl are in cahoots.

i bet it'll be appealed and won at a higher court.

10 To many more rulings like this and we'll have to start patrolling our northern border as stringently (shit man, I'm killin' myself here) as we do our southern border. Otherwise we'll have a tide of illegals coming over the border looking for a better enviornment in which to raise their kids. And this time they'll be taking jobs that Americans will do. How do you say mojado in Canadian?

16 My mother tells me "payback is hell" any time any of my kids get the least bit out of line.  And she says it with a cackle.  Someday this daughter's going to be dealing with her own kids, and it's all going to come back on her.  Assuming the mom doesn't pay for a string of abortions along the way, considering she's encouraging her daughter to act like a slut, and that she's teaching her daughter that parental discipline is something you sue to get rid of.  That mom's going to be begging her ex to take this girl off her hands in no time.

Guys, let this be a lesson to you - be careful who you run the risk of knocking up, because you can end up in a situation like this, where no matter how hard you try to do a decent job raising your kids, your baby mama is working hard to thwart you at every turn, just to make your life hell.

27 To further elaborate, even if it was just a mild picture, what the hell is a judge doing getting involved in a parental matter?  Was there a law broken at some point?  Would the judge like to raise the kid, now that the father has given up his custody?

Posted by: Cautiously Pessimistic at June 19, 2008 02:51 PM (ltwze)

28 If the parents were in the midst of a custody battle, even in the U.S., they have essentially forfeited having the last word on these issues to the courts. The rule, at least where I live, and where I practice law is, once the court assumes jurisdiction over children, it retains it until they are 18 (or 21 if they go to college.) This means that either parent or the child can go to court to modify or review these sorts of decisions. That said, I've been appointed to represent kids in divorce proceedings and have had them call me complaining about one or both parents. Absent abuse or neglect allegations, my answer is always the same: " They're your parents. Live with it. I'm not going to waste the court's time or your parents' money fighting about whether you get to play little league baseball." Regards.

29 So what is the point in sending home a permission slip if "no" isn't an answer?  It then becomes a trip mandated by the government.

That Dad needs to learn how to dad-yell.

My dad had "the grit".  He wouldn't yell at all, he would just grit his teeth and speak through them.  Very slowly and deliberately.  It would scare the ever loving shit out of me and my sister.  Even now, brr, chill went down my spine just thinking about it. That, and he had a fraternity paddle like the one in Animal House.  He never actually hit us with it.  He would just take it out and wave it in the air, the wind it created would make you want to run through a wall to get away.

Of course, it didn't hurt that he was as big as an ox and twice as strong.

The follow-up story to this one in a few months will be the father refusing to pay for the abortion the kid needs after having let 4 teenage boys pull a train on her on the school trip, and the mother trying to force him to pay for it, with the Court saying, "why, yes, she must have an abortion, because she's only 12 and of course that's the correct thing for her to do because she's not old enough to be a mom, so we'll order the abortion, and order the father to pay."

Or, nine months later the follow-up story is whether the kid conceived as previously mentioned (a train, you dirty-minded bastards) should be under the custody of the mom who let the 12 year old dick sponge go on the trip, the father who didn't want her to, or whether the fucking superior court of fucking Quebec should have to take care of the newborn!  Wonder how that ruling would work out . . .

Canada has free universal health care, abortions included.

A girl doesn't even need her parent's knowledge or permission to have one.  All the girl needs to do is go to a clinic and present her health care card.
