For a while, I wouldn't have been surprised at all if some of the Phelps gang ended up getting shot and killed by a relative driven insane by grief. Thankfully, however, it looks like they will simply be litigated to death--and now there is legal precedent to back it up.

Couldn't have happened to a nicer bunch of douchebags.

7 Phelps may have achieved the unique position of being the most hated man in America. Libs hate him because he's anti-gay -- and he doesn't hate the sin, he's nasty about hating the sinners. Conservatives hate him because he disrupts military funerals (and generally disses the U.S.A. because the rest of us don't "hate fags" as much as he does). I think he's more disliked than Bin Laden -- if only because even the moonbats who think Osama's a hero for fighting the Halliburton Imperialist Oil-Vampires still think Fred Phelps is a dick.

The 1st Amendment prohibits THE F*CKING GOVERNMENT from restricting free speech.
That doesn't give every douchebag with an axe to grind the carte blanche privilege to crash a private, non-governmental event, such as a funeral.
Just as you don't have to let me have a protest march in your family room, the bereaved family is permitted to restrict who can attend their ceremony.
Courts have held that there can be protests within a certain distance (such as outside the Abortion Mills).

10 While no one in the U.S. deserves to be hit with this verdict more than Phelps and his church, I have to agree with JSinger that this may set up a dangerous precedent. Even if they were trespassing on private property, I don't see how they could have caused 2.9 million dollars worth of damage.

12 When ever someone people don't like says something uncomfortable and unpopular lets hit them with mutlimillion dollar judgements to bankrupt them and shut them up. Hell yeah sign me up for the dangerous precedent award. I don't mind maknig a law to keep them away from funerals and religious services but the million dollar judgements are absurd

15 The story doesn't say how much was actual damage and how much was punative. I hope they take every cent this 'church' has and find some way of ruining Phelps too.

The Klan was bankrupted about ten years ago with lawsuits. Not for their opinions but for incitements that led to deaths. Of course the Klan is back, on a very small scale, they just reform as a slightly differnt organization.

As several people pointed out this is not a free speech issue. The government didn't do one thing to stop Phelps from speaking.

Totally the reverse: it was Phelps and his gang that interfered with others.

Serves the *sshats right. The Phelps clan was causing trouble out Topeka way back in the early '90s when I spent a stint as a Kansas resident and even then, they were complete scumbags.

I understand JSinger's concern, but I think that this is a case where the speech has crossed the line to conduct--the public disruption of a private event for the express purpose of causing emotional harm. In that case, the First Amendment doesn't apply at all. So fuck 'em.

Apparently the cult of the phelps are planning to come to Perth City, Western Australia to disrupt Heath Ledgers funeral and allready they're spouting revolting biblical abuse. They also sent a letter to Heaths parents telling them heaths in hell and they better heed phelps message or join him in hell......
