The son of state Rep. Mike Kernell has been contacted by authorities in connection with a probe into the hacking of personal e-mail of vice presidential candidate Sarah Palin, Kernell told The Tennessean.

Kernell, a Memphis Democrat, said his 20-year-old son David had been contacted by authorities investigating the hacking of Palin’s personal e-mail account, the newspaper reported on its Web site this afternoon.

The FBI and the Secret Service started a formal investigation Wednesday into the hacking, according to the Associated Press.

If AP can steal and publish Sarah Palin's emails, what right do they have to complain?

Incidentally, Palin's emails were "hacked" -- in the loosest sense of the word -- by simply using yahoo's "I forgot my password" helper. The "hacker" simply guessed at the answer to her security question. Which was, unfortunately, what high school did you attend. And the answer was pretty easy to guess -- "Wasilla high."

AP remains in contact with the hacker:

“The person who claimed responsibility for the break-in did not respond Thursday to an e-mail inquiry from The Associated Press.”

And yet they are, as of last notice, still not complying with the Secret Service's request for the emails, despite the emails being evidence of a federal crime.

Yes, I believe we were discussing it here last evening, as well. Rubico10 is the username the hacker posted with. Rubico10 also has an account on New Grounds, which links to what it says is his personal website. There he gives his real name, says Fox News is a hypocrite, and says he lives in Tenn. A Democratic legislator in Tenn. has a son with the same name.

There was a YouTube account for Rubico10 last night but it's deleted today. Other profiles have been cleared and the legislator father refuses to comment on the matter.

Instapundit sez: "The hacker said that he read all of the e-mails in the Palin account and found "nothing incriminating, nothing that would derail her campaign as I had hoped. All I saw was personal stuff, some clerical stuff from when she was governor…. And pictures of her family."

So if this dickweed was a remotely cool customer, he would have scanned the trove for useful dirt, and finding none, should have just clammed up, and even saved what he knew (access) for another day, or at least not burned himself.

But he just HAS to be all smarmy and hip, and let us all know how cool he is, even anonomously, and he has to put the hurt on the Palin family, even though they can reover reasonably easily. And now her sympathy reserve rises and the Feds are on his case, and Bill O'Reilly is calling attornies general daily to see what they are doing about it all.

However, he did say the guy had at least two psych hospitalizations, which mean he could be nuts, or he could be a little sniveling sociopath.

Penfold:  I agree because it's too much of a hassle. However, there is no federal privledge to a newsman source. In fact, it would be fun to stick a couple of AP reporters in jail for contempt indefinitely.  I'm bad though. If the plane carrying the reporters crashed, I would shed no tears.

73 Let me be the first, and perhaps the last, to say, "Go easy on this kid."  Or at least be measured and deliberate.  If indeed he's been institutionalized twice, there simply isn't any benefit weighed against the cost of trying to "punish" him in some way commensurate with how sick the hacking made most of us.

If he can be linked somehow to some secret Obama action alert, then fine, but parachuting in the on-call right-of-center blogosphere firing squad to make this kid pay just feels like it is not a very good idea.  Let the act speak for itself.  It was a crime, and he'll face it.  Whether or not it hurts Palin depends in large part on how we react.  If we emphasize that even the hacker says he didn't find the dirt he was looking for, it can be a positive.  If we emphasize our desire to descend upon him and give him an online pounding he'll never forget, then the emphasize will be in the wrong place.

“My son’s the one in question and I can’t comment on him,” Kernell said.

The state representative also would not say whether rubico10@yahoo.com is or is not his son’s e-mail address. “I can’t comment on my son,” he repeated.

Kernell said he has not been contacted by investigators. “I can't say about my son,” he added. “That doesn't mean he has or hasn't been contacted.”

David Kernell, now a student at the University of Tennessee in Knoxville, could not be reached.

95 Erik, there is a very slim chance, but a chance nonetheless, that someone used his ID and made up his story to frame him. One thing that's new is that his identity as son of Senator Kernell has been confirmed. If his son had no possible connection to this case, it would have been strongly asserted by now. I emailed the Senator myself last night, as I'm sure hundreds other did, so it's not as though he wouldn't be aware of the threat to his son's and his own reputation.

So a person claiming to have broken into Palin's Yahoo account (I hate to say hacker but cracker has not fully entered the lexicon) used a Yahoo address that at once belonged to a state representitive.  I see more than one problem here (person taking credit might not be the one who did it, or may have broken into the representitive's account as well).

If it is a user of the representitives account, why assume it is the college age Son?  It could be another relative or the representitive himself.

Let's hold our anger a little bit.  Remember the blogger falsely accused of being the Virginia Tech killer?  There were a lot more coincidences there than in this case.

It is quite possible that he did it.  Yes, it would be highly stupid to put forth a post including his email address on a forum, even a non-logged forum where the post was guaranteed to disappear and non-searchable, but put yourself in the shoes of a relatively privileged 20-year-old: if the rubico post was really made by him, and rubico was the original anonymous poster, then the guy panicked.  He was scared, and lonely, and he wanted somebody to talk to.  Maybe he posted with an email address because he was hoping somebody would email him, so he could keep the conversation going.  It is dumb as hell.  But plausibly dumb.  I don't have any problem believing he would do that. 

But y'know what?  Maybe he didn't.  Maybe somebody who didn't like him spoofed his email address.  Maybe he is the rubico poster, but just tried to claim involvement to boost his cred, and he wasn't the original guy who broke into Governor Palin's account.  Those are still possibilities, too. 

The feds are on it.  They'll find out.  The lack of a statement from his father -- not even a pro forma "My son has nothing to do with this incident and is cooperating fully with authorities" -- suggests that they're seriously interested, but it's early yet.  Give 'em some time.  Give the feds a chance to check the server logs, and the guy in question a chance to talk to his dad and his lawyer, and the dad and lawyer a chance to figure out what they're going to say.

If they're charging him, we'll know soon enough.

ot that I have any great desire to tangle with the big guy, but the fact is that the Palin children are not fair game.  I do not accept the authority of those who suggest that they are.  As for the 20 year old criminal, he is certainly fair game to the authorities.  His father is fair game, ironically, for having devoted himself to pursuing political office since at least 1975 while he had a vulnerable child at home who needed him.

I am glad that some here see the enormous political potential of Palin calling State Representative Kernell and saying something along the lines of "tell your son I forgive him.  I hope that he learns something from the consequences that are sure to come."  And forever after, Palin will have the moral high ground on any privacy issue.

We are great parents!  Yeah, I know he seems like a scumbag, but it's society's fault.  All the other kids were mean to him because of his unusual attraction to the dog, then that thing with my wife, then the thing with the 4th-grader... well, we thought the kids would like him better if we tied him up in a burlap bag and let them urinate on him, but they just kept picking and picking on him.  We were at our wits end so we turned the entire problem over to the psychiatrists.  Then, when he returned home, we felt like there was nothing we could do but give him the drugs and keep him locked in his room.  Best for everybody.  Can't have an embarrassment like him on the campaign trail.  Then, when he was old enough, we shipped him off to college.  We did the best we could!

I'm very sensitive to the plight of people with depression, too, and struggled with some of the piling on that I was reading. Depression is a terrible, terrible disease. It's one of the few diseases which are so intolerable that make humans kill themselves.

I pray that this young man gets help -- both medication and canceling.

However, having depression is not a defense to a crime, and Kernell committed a crime. I would imagine that he is in FBI custody this moment and his disease is less likely to be affected by this blog than what he is going through.

335 Yeah, look, I'm no stranger to depression myself, but it has never driven me to break federal laws in order to destroy a political opponent.  That this stupid douche appears to have failed is not much of a reason to go light on him.

Another thing about depression is that it's not always the easiest thing to understand.  Sure, in some, perhaps many, cases, it's a chemical thing that requires drugs and/or some kind of talk therapy.  Sometimes, though, it's just having a lousy attitude, a lack of perspective and unrealistic expectations of life.

Maybe the latter version applies to this dumbass, in which case maybe a nice long stint in prison might give him a much needed perspective shift so that he can live a better life afterward.

I don't care for the rape jokes, either, but trying to stop those seems futile.  That's not a partisan thing, either.  The Left loves to joke about right-wingers getting assraped, too.  It's just one of those unfortunate traits of human society.

his myspace page says it all then he's too cowardly so he makes it private so he doesn't have to face the public 

he's not mentally impaired : "David Kernell is a sophomore engineering physics student at UT" he's just stupid, devious, hateful and cruel. who has no life other than dance and chess...(explains a lot)....so he takes his deep seated obsession with palin and his hatred of women out on her and her family.

if he off's himself because of this its because he brought it on himself...palin or her family did not seek him out or ask for this.

as for those who think it was just a prank .....lets put your info on the net, your personal pics & info on your kids and see if you feel the same way.

there s a much bigger issue than this just being palin's email and personal info,  it could be yours or mine and god forbid if it were obama's as it would have been a media shit storm if his family had been hacked.

This is all a set-up by the Obama camp. They used this kid (I'm sure he and his pol father were willing participants), created a phony blog site in his name with crazy postings he supposedly wrote about anarchy and proclaiming he was institutionalized twice for mental illness. The purpose of the postings is to get the kid off citing the blog as proof he wasn't in his right mind. The kid will get off with a slap on the wrist and a suggestion he seek therapy. This is so easy to figure out Obama and Axelrod must think people are as dumb as they are to think this kid worked alone.

He hacked into Sarah Palin's email. I'm aware of that. That doesn't mean a lot. Sure, he may have done it to "look for incriminating evidence", but did he find any, and would he have used it had he found any? I think not. I believe that he was just trying to hack into her email to see if he could, a kind of "look what I can do" attitude. Once he realized what he had done, I'm sure he was terrified. Really though, I don't think he deserves anything like the type of punishment you all would bestow upon him. Consider if he had hacked into some random person's email by guessing at their password, what would have happened to him? Most likely nothing, and why should anything change just because it's Sarah Palin? What he did is not a felony crime, it's a minor misdemeanor at most and should be treated as such.
