The son of state Rep. Mike Kernell has been contacted by authorities in connection with a probe into the hacking of personal e-mail of vice presidential candidate Sarah Palin, Kernell told The Tennessean.
Pic courtesy of My Pet JawaKernell, a Memphis Democrat, said his 20-year-old son David had been contacted by authorities investigating the hacking of Palins personal e-mail account, the newspaper reported on its Web site this afternoon.
The FBI and the Secret Service started a formal investigation Wednesday into the hacking, according to the Associated Press.

If AP can steal and publish Sarah Palin's emails, what right do they have to complain?
Incidentally, Palin's emails were "hacked" -- in the loosest sense of the word -- by simply using yahoo's "I forgot my password" helper. The "hacker" simply guessed at the answer to her security question. Which was, unfortunately, what high school did you attend. And the answer was pretty easy to guess -- "Wasilla high."
AP remains in contact with the hacker:
The person who claimed responsibility for the break-in did not respond Thursday to an e-mail inquiry from The Associated Press.
And yet they are, as of last notice, still not complying with the Secret Service's request for the emails, despite the emails being evidence of a federal crime.

Yes, I believe we were discussing it here last evening, as well. Rubico10 is the username the hacker posted with. Rubico10 also has an account on New Grounds, which links to what it says is his personal website. There he gives his real name, says Fox News is a hypocrite, and says he lives in Tenn. A Democratic legislator in Tenn. has a son with the same name.
There was a YouTube account for Rubico10 last night but it's deleted today. Other profiles have been cleared and the legislator father refuses to comment on the matter.

And now her sympathy reserve rises and the Feds are on his case, and Bill O'Reilly is calling attornies general daily to see what they are doing about it all.

My sons the one in question and I cant comment on him, Kernell said.
The state representative also would not say whether rubico10@yahoo.com is or is not his sons e-mail address. I cant comment on my son, he repeated.
Kernell said he has not been contacted by investigators. I can't say about my son, he added. That doesn't mean he has or hasn't been contacted.
David Kernell, now a student at the University of Tennessee in Knoxville, could not be reached.

So a person claiming to have broken into Palin's Yahoo account (I hate to say hacker but cracker has not fully entered the lexicon) used a Yahoo address that at once belonged to a state representitive. I see more than one problem here (person taking credit might not be the one who did it, or may have broken into the representitive's account as well).
If it is a user of the representitives account, why assume it is the college age Son? It could be another relative or the representitive himself.
Let's hold our anger a little bit. Remember the blogger falsely accused of being the Virginia Tech killer? There were a lot more coincidences there than in this case.

That's not my point. This story is going to fall one of two ways, in Palin's favor or against her. Using hyperbolic mob language, however tongue in cheek, against a kid who, quite frankly, presents a quite pathetic image, will only shift the story to one of sympathy for him (at least among those who pay attention to blog comments).
Let the authorities deal with the kid. Law enforcement is what found him in under 48 hours; we didn't.
Now having said all that I will note the irony that his last blog post is about a story he was writing that culminated in stealing mail.

Yes, it would be highly stupid to put forth a post including his email address on a forum, even a non-logged forum where the post was guaranteed to disappear and non-searchable, but put yourself in the shoes of a relatively privileged 20-year-old: if the rubico post was really made by him, and rubico was the original anonymous poster, then the guy panicked. He was scared, and lonely, and he wanted somebody to talk to. Maybe he posted with an email address because he was hoping somebody would email him, so he could keep the conversation going. It is dumb as hell. But plausibly dumb. I don't have any problem believing he would do that.
But y'know what? Maybe he didn't. Maybe somebody who didn't like him spoofed his email address. Maybe he is the rubico poster, but just tried to claim involvement to boost his cred, and he wasn't the original guy who broke into Governor Palin's account. Those are still possibilities, too.
The feds are on it. They'll find out. The lack of a statement from his father -- not even a pro forma "My son has nothing to do with this incident and is cooperating fully with authorities" -- suggests that they're seriously interested, but it's early yet. Give 'em some time. Give the feds a chance to check the server logs, and the guy in question a chance to talk to his dad and his lawyer, and the dad and lawyer a chance to figure out what they're going to say.
If they're charging him, we'll know soon enough.

As for the 20 year old criminal, he is certainly fair game to the authorities. His father is fair game, ironically, for having devoted himself to pursuing political office since at least 1975 while he had a vulnerable child at home who needed him.
I am glad that some here see the enormous political potential of Palin calling State Representative Kernell and saying something along the lines of "tell your son I forgive him. I hope that he learns something from the consequences that are sure to come." And forever after, Palin will have the moral high ground on any privacy issue.

But it's not. Politics is a game that keeps going and going and going. Opponents influence one another's strategies. Acting weak and forgiving influences their future moves. By showing that there is a cost associated with attacking us, we decrease the chance that they will consider it worthwhile to attack us.
If you really want to make politics a friendlier pursuit, you should actively advocate strong reciprocation of nasty attacks because it makes your opponent more likely to be friendly the next round and frees you up to do the same.

Another thing about depression is that it's not always the easiest thing to understand. Sure, in some, perhaps many, cases, it's a chemical thing that requires drugs and/or some kind of talk therapy. Sometimes, though, it's just having a lousy attitude, a lack of perspective and unrealistic expectations of life.
Maybe the latter version applies to this dumbass, in which case maybe a nice long stint in prison might give him a much needed perspective shift so that he can live a better life afterward.
I don't care for the rape jokes, either, but trying to stop those seems futile. That's not a partisan thing, either. The Left loves to joke about right-wingers getting assraped, too. It's just one of those unfortunate traits of human society.

Last night I was horrified and angry. Tonight I am saddened. How can the political process in my country, the country I love, the country of my birth have deteriorated to the point where one candidate can have a cult like following that ofttimes does not think beyond wanting to be part of the group. Worse yet, how can everyone see this and stand by and watch it happening? If people are so brain washed that they neglect their own self interest then this is a red flag for our society.

If this young man committed this crime, to hell with "Oh, he has depression issues he's had to work with. Give him a break. It would be the decent thing to do."
We're not here to do the "decent" thing, to allow a sentient adult commit a crime and, knowingly, try to exacerbate the initial offense by maliciously digging for dirt and intentionally spreading it around for others to sift.
Imagine if something had been found, something that led to some other nugget of exploitable data that ended up destroying a Presidential campaign. Would that be acceptable? Is that the new standard for deciding whether to prosecute? Even those who sabotage Presidential campaigns and end up costing people their careers, their reputation, their expectation of privacy, hundreds of millions of dollars, and the integrity of legitimate campaigns (the backbone of a democracy) can escape serious charges because they have "issues?"

Investigate. Prosecute. Try. Convict if guilty. Full sentencing as mandated. This ain't tiddly-winks. This is serious stuff in a new age of digital crime. Does that mean physical harm should come to him? No. It does mean, however, that incarceration is not an unreasonable, unfair, or indecent sentence to administer. The indecent thing would be to let him skate.

He hacked into Sarah Palin's email. I'm aware of that. That doesn't mean a lot. Sure, he may have done it to "look for incriminating evidence", but did he find any, and would he have used it had he found any? I think not. I believe that he was just trying to hack into her email to see if he could, a kind of "look what I can do" attitude. Once he realized what he had done, I'm sure he was terrified. Really though, I don't think he deserves anything like the type of punishment you all would bestow upon him. Consider if he had hacked into some random person's email by guessing at their password, what would have happened to him? Most likely nothing, and why should anything change just because it's Sarah Palin? What he did is not a felony crime, it's a minor misdemeanor at most and should be treated as such.
