Military ballots are being tossed in Fairfax Co, VA because of a technicality. Not a lot of them compared to the size of the electorate, but more than a few.
The registrar of voters in a Democrat. He thinks it stinks, but the law is the law.
Fairfax general registrar Rokey Suleman said Thursday that he has had to reject some of the ballots because of a Virginia law passed in 2002. That law -- then called Senate Bill 113, sponsored by then state Sen. Bill Bolling requires that when an overseas citizen wants to request an absentee ballot and cast a vote with the same paperwork, it requires not only a witness signature but also the current address of the witness.
The McCain campaign said theres not even a space for the witness to list an address. Suleman agreed; he said the federal document was changed in recent years and the space for the witness address was removed. But the Virginia law hasnt changed.
Democrats insist theyre biased towards access... so will they try to intervene on behalf of these voters?

Incidentally, a quickie law could fix this.

In that case, Democratic registrars are "easing" the rules (that is, breaking the law) by allowing non-resident college students to cast votes in swing state Virginia, despite the typical law that voters must have a permanent abode in the state.
And who pressured them to do this? Well, the Obama campaign, among others.
Think he'll make a call regarding our soldiers based overseas?

If the federal document was changed, the federal administrative rule changing it should preempt state law to the extent of the conflict. The problem is that the proper plaintiffs, the absentee voters, aren't around to sue quickly enough to stop this.

Actually this law may not be as bad as it sounds. You can see info on it here. It looks like the witness name, signature, and address are only required when the soldier is requesting an absentee ballot and voting at the same time. This was to avoid the situation where a soldier had to mail a request in, get the absentee ballot, and then mail it back before the election. Here's more info.
That said, the selective enforcement of election laws is the real outrage here.

§ 24.2-702.1. Federal write-in absentee ballots.
A. Notwithstanding any other provision of this title, a qualified absentee voter who is eligible for an absentee ballot under subdivision 2 of § 24.2-700may use a federal write-in absentee ballot in general, special, and primary elections for federal office. Such ballot shall be submitted and processed in the manner provided by the Uniformed and Overseas Citizens Absentee Voting Act (42 U.S.C. § 1973ff et seq.) and this article.
B. Notwithstanding any other provision of this title, a federal write-in absentee ballot submitted pursuant to subsection A shall be considered valid for purposes of simultaneously satisfying both an absentee ballot application and a completed absentee ballot for federal offices only, provided that the ballot is received not less than five days prior to the election in which voter offers to vote, and the application on the envelope contains the following information: (i) the voter's signature, however, if unable to sign the person assisting the voter will note this fact in the voter signature box; (ii) the voter's printed name; (iii) the county or city in which he is registered and offers to vote; (iv) the residence address at which he is registered to vote; and (v) his current military or overseas address. The envelope must be witnessed, and the witness shall provide his signature, printed name and address in the witness signature box.

The little lady and I go to early vote. We start talking to a guy with a McCain sign out front, far enough away from the polling place to be legal and fine. Dick Head comes running out saying the guy with the McCain signs is breaking the law. McCain guy says, "No. I'm legal. They came out and measured earlier." Dick Head runs back in after snapping a few pictures with his cell phone camera. Dick Head comes back out with an election Judge of some sort and is promptly told that the guy with the signs is fine. Legal. No problem. Then my wife notices that the Dick Head is wearing a fucking Obama button! I ask the elections Judge, "Is he supposed to be wearing that button in the polling place?" "No, he isn't." says the elections Judge. Dick Head looks like the complete ass-hole that he truly is.

Thanks much for this item. I linked to you and spread the word to my blog friends at the Old Dominion Blog Alliance. I also informed my State Senator, Ken Cuccinelli (R)-37) (who is running for Attorney General next year). I will be notifying the Fairfax County Republican Committee.
I followed the Atlantic's link and got to the Newport News Free Press. Its article said that in other counties and cities in Virginia, this is not a problem.
The Virginia General Assembly is now split. The State Senate has a 21-19 Dem majority as of last year, while the House of Delegates has something like a 53-46 GOP majority and is up for re-election next year. The Governor (Tim Kaine) is a Dem while the LG (Bill Bolling) and AG (Bob McDonnell) are Republicans. The LG is running for Gov. next year, while the LG is running for re-election as LG.
By the way, Keith Fimian, the Republican candidate in Virginia's 11th District, has a great ad against Gerry Connolly. See this.

They'd better NOT be throwing those ballots away just yet. There's still time to turn this around. Republicans can save our men and women in uniform from being disenfranchised while at the same time scoring HUGE POINTS with patriotic Americans by getting in there and making a legal challenge.
The military needs to lead the charge on this. Having served in the military - there is always a push every election to register military members for absentee ballots. Every unit in the military has a "Voting Officer" that coordinates this for his/her unit's members. It's a serious duty.
We need to write Chiefs of Staff of each military service and ask them ... "WTF?". It won't do any good to write the Secretaries of the Services - they're Republican political appointees and won't do anything. But the Chiefs of Staff can put pressure on the State of Virginia - and they can do that personally because they are physically present IN Virginia.
Additionally, VIRGINIA DEMOCRATIC SENATOR JAMES WEBB is a former Marine Infantry Officer and Secretary of the Navy. His military roots run deep. He needs to BE EMBARRASSED. At the very least - we need a quote from him on what he thinks about this. If he condemns it - it will help us get these votes counted. If he refuses to condemn it - we can use that fact to throw his lame ass out of office next election.

About midmorning, the Fairfax elections office had to shut down its e-mail servers after they took in more than 700 form e-mails from TrueVote.US...."It just shut us down," Suleman said.

I live in Fairfax County, VA, as it happens. Yep, Connolly & krewe are as corrupt as they come. It gets national press at times, such as with our Islamic Saudi Academy kerfuffle and tax assessment hilarity.
I've certainly seen it at the polls. In the 2006 mid-term I had a lady in line in front of me who produced a California drivers license when asked for ID by the poll worker. Here's how it went down pretty much verbatim:
"Uh, that's not a Virginia drivers license."
"Well, I live in CA but I have a house here, too."
"Uh, can you show me your Virginia voter's registration card?"
"No, I just flew in. Do I vote over there?"
"Uh, yeah, have this sticker."
Also, I was working outside the poll as a Republican volunteer when, about 3 minutes before the poll closed, some Democratic voters showed up to vote, but at the wrong precinct. Theirs was a 30 minute drive away, easy. "No problem!" said the Democratic poll worker, "We have a judge we can call."

Distribute the new ballots and round them up to be returned. Time 48 hours.
Then those same F-15's return to Andrews and the new ballots are hand delivered to said asshole. Time 24 hours.
Total time for expedited turn around - 5 days.
If asshole has any objections, the officer doing the delivery should be authorized to shoot him on the spot as a grave threat to national security.
