Weiner to Media: Respect My Silence On This Affair

Did I not just say we were entering the "please respect my family's privacy" phase of this?

Looks like that tantrum of mine was utterly unnecessary, eh? CNN had the bomb and was about to blow it up.

Of course, no Democratic sex scandal is complete until Amanda Marcotte embarrasses herself. Like, claiming the NYT -- which actually spun for Weiner claiming that maybe he had a "staffer malfunction" --- was sexually harassing him by blaming the victim.

Her headline is that the NYT is picking on Weiner for wearing a skirt that's too short. See, like a rape victim.

The New York Times really takes the cake this morning by demonstrating that anyone, even a man, who is victimized by sexual harassment is eligible for victim-blaming. Their argument is that Weiner brought the sexual harassment onto himself (and this poor young woman, apparently) by wearing his opinion skirt too short. Also, by being a social networking slut.

I wish I could say this is the first time that I've heard that victims of sexual harassment deserve to be abused because they dare to have a presence online and they aren't ladylike or mincing. Granted, I never thought that the person accused of slatternly use of social networking bringing sexual harassment onto zirself would be a dudely congressman from New York, but okay. It just shows that "she had it coming" is incredible versatile.

In a way, it makes sense. Much of the mainstream media, and especially much of the New York Times, views Democrats as symbolically female. Therefore Weiner can be dinged, in their minds, for unladylike behavior. But still, it's kind of strange.

And of course, the closing paragraph is about how, even though the victim has been punished by a cranky old asshole who uses sex as a weapon against people he doesn't like, the victim isn't going to learn his lesson, roll down his skirts, cross his legs, and shut the fuck up.

Unabashed! Unashamed! Weiner is such a slut. Doesn't he know that Democrats who don't keep their opinions to themselves deserve to be buried under penis pictures?

I suppose we should be grateful, at least, that the author of this piece, Ashley Parker, didn't blame the other victim in this, the young woman who received the penis picture.

Mm-hm. That's a perfectly reasonable reaction to this story: Anthony Weiner, rape survivor.

Well, in Amynda's defense, her thesis is based upon Weiner's first incredible lie - and not the subsequent contradictory but more plausible lies offered to explain away the first lie - which is easily disprovable with just a smidgen of good faith effort on the Honorable Weiner's part, but which could well expose him to criminal sanction for making a false report.

I think we're all missing a part of this that gives me a giant throbbing schadenboner that cannot be constrained by a solitary bolt of gray cotton.  Over the weekend, the Honorable Weiner must have told Huma one of his early lies, believing at the time that the whole thing would be disappeared by Tuesday with an assist from the MBM.  Now he's hemmed in not only by his first, public story about having been hacked, but quite possibly by another, different lie that he told his wife but which by now must be quite obviously false as well - or which will be contradicted by his next attempt to explain the incident away.  "Look, Huma honey, this is what really happened [insert story that doesn't include something which could be construed by a woman as cheating or preparing to cheat]."  Whatever he told her is probably very easy to disprove now, so it is no longer available as a cover story - but neither is the next lie if it contradicts what he told his wife unless and until he admits that he lied to her.  Weiner's in a pickle.

That's just stupid.  Just because the perp-hacker has been identified doesn't make what he did (didn't do) not a crime.  And pursuing the matter criminally doesn't foreclose a civil action - in fact, if a crime is proven which contains the elements of a civil cause of action, a civil trial on the merits is often not necessary, and all the Plaintiff(s) need do is prove their damages.  e.g. a conviction for battery precludes a trial (a defense, really) as to the fact of the battery, and the Plaintiff proceeds to prove his or her damages.

In a civil case, you may ask the Defendant whether he did such a thing which constitutes a crime and he may refuse to answer and invoke his 5th Amendment Rights, at which point the Plaintiff(s) would receive either an inference that the Defendant did the thing, or the Defendant could be precluded from offering testimony that he didn't do the thing - neither of which is an admission for the purposes of a criminal prosecution.

If you want to make a crimminal case out of it you have to do it in crimminal court. That is why everyone goes to crimminal court before they file a civil claim. In a crimminal claim they don't need discovery. They can seize your computer with a search warrant and supeona the logs of your internet accounts. You also don't open yourself up to discovery with that method and you have the advantage of suing a convicted crimminal.

Actually, dipshit, you can invoke it in any case or controversy, and even - wait for it - when testifying before Congress (that may come in handy for your beloved Honorable Weiner).  If you were as smart as you were heavy, you'd have understood that I laid out the available remedies of such inferences and preclusive sanctions for discovery violations (i.e. refusing to answer a question which does not seek privileged or non-discoverable information).  The preclusive sanction or inference is itself the remedy (Judge says, "Jury, you are instructed that you are free to find that the Defendant did X, Y, and Z).  If you weren't absent the day they taught law at lawschool, you would know that one can't be punished (contempt proceeding in the nature of deprivation of liberty) for invoking a Constitutional Right (against self-incrimination).

And while there is quite a bit of case law on the notion that merely claiming the 5th, and allowed to do so, cannot, by itself, found a summary judgment claim, or be used in a subsequent chase after aiders and abettors in the damages assessment or enforcement phase of the civil proceeding, the questioner really does not all THAT much to add to the invocation of the 5th to get summary judgment: for instance, an admission of having caused the picture to be sent, directly OR indirectly (which is not really not open to being defeated by the 5th, because that point is "determinative" towards the ultimate outcome of the civil proceeding), plus invoking the 5th on questions going to the issue of whoever aided or abetted, in anyone, plus records showing direct or indirect contact with the alleged aider(s) or abettor(s), plus an independently proven history of the alleged aider(s) or abettor(s) demonstrating a PROCLIVITY for such 'pranks', would be more than enough to found summary judgment. And thereafter, it reduces to a matter of chasing after whoever the defendant had contact who also had that proclivity. 423 I'm telling you, there's someone else involved in this -- the young lady who actually did have some contact with Mr BallPark. Sooner or later it is going to occur to her that there might be a payday in all of this for her, one way or another if you get my drift. Who is going to believe she's the culprit in all of this?  She makes a tearful confession on camera ("I told him to stop sending those *sob*..."), lawyers up. somewhere down the line gets book/appearances/moviedeal, and makes out like a bandit until everyone loses interest.

That shoe has not dropped yet. It may not drop ever but it has to have occurred to her or one of her friends. If some enterprising journalist could nudge her to see if she is leaning already, well that's got to be prize-winning journalism, right?
