Update: Nail-Biter
— Ace

Murky is outperforming her election-day performance, which becomes a problem when she starts getting above 50%... below that, and she continues losing votes, above that, she eats into Miller's lead.

It looks like in most areas she will be above 50%. But how far above?

Counting from Miller's own stronghold of the Mat-Su valley (Palin's area) got him about +150 votes, which is okay, but not as many as Murky got from hers. He still has Fairbanks; but she still has "the bush," which, the thinking goes, will support her because they like her style of Big Daddy federal dollar subsidies.

5000+ votes have been counted, I think, leaving maybe 6000 to go, and Miller still has a 1400 vote edge.

4:29pm: The Anchorage Daily News reports that the latest batch of absentees came from the Mat-Su valley, specifically House Districts 13 through 16. Crunching the numbers myself, on election day, Murkowski won 38% of the vote in those districts. Among the absentees, she's picking up nearly 48% of the vote -- a much bigger improvement than among the Anchorage absentees, but she still has a long way to go.

Districts 13-16 The Anchorage Daily News reports this latest batch of new ballots was from Districts 13-16 -- the Mat-Su Valley (Palinland). Miller won 62.12% of the vote in those districts on Election Day, but he only won 52.33% of the new ballots from those districts. With all of today's ballots, Murkowski is now out-performing her Election Day numbers in all districts that have been counted today by 5.9%. If that were to continue in all districts across the state, she would need a total of 16,690 new ballots to be counted to pass Miller.

I don't know whose blog that's from -- if you know, please tell me.

Bear in mind Murky's overperformance, and Miller's underperformance, aren't really unexpected -- I always thought that these ballots would skew Murky due to the fact that many were cast long before Miller appeared viable (and before anyone really heard of him).

The ADN is also liveblogging the counting.

So is The Other McCain.

Hey, Guys! I Just Found A Stack of Ballots! But of course you did, darling.

If it's any consolation: Murkle's camp wasn't even that optimistic about winning the absentee ballots, originally. If she was optimistic she wouldn't have openly toyed with the idea of getting on the ballot as a 3rd party candidate.

Now this is not the case.  I didn't win?  Bring in the fucking lawyers!  Who cares if we put the state or country through the ringer?

9 So, for what we've seen thus far, Murkowski well outperformed the election night numbers in areas she didn't win (Mat-Su), and outperformed, but less so, in areas she did win (Anchorage). Based on this we couls presume Anchorage-like numbers from Juneau, and Mat-Su-like numbers in Fairbanks.

Tight any way you slice it, but better to be in the lead than waiting on ballots never cast.

They are NOT re-counting.  They are counting all the votes cast.  You sort of can't tell who won or lost until you count all the votes.  (Look at the current election results in Australia: their whole country is still locked into a first count of the vote.)

If the margin is slim enough, there may be a statutory requirement to perform a recount.  If and when they get to a second re-count or a lawsuit, then I am all with you on the "concede with dignity" thing.

I'll bet you're wondering if we ever had a "Miller" in the U.S. Senate.

We had two.

Can you name them? One of them was John Franklin Miller (R) of California who served from 1881-1886. He died in office.

Who's the other one? Come on, you remember him.

Remember the guy, Mike Roman, that Miller accused of accessing the computers, texting on his phone, and trying to bring in a bag to the counting area?   Well, guess who he is.

He worked on the Norm Coleman recount.   He's some kind of veteran elections consultant & private detective.   It was reported that he was brought in by the NRSC, but Murky is denying that, and saying that Bitney (who works for her campaign) requested him.

I'm sorry, but this crap is just hokey.

Alaska statute:

A defeated candidate or 10 qualified voters may contest the nomination or election of any person or the approval or rejection of any question or proposition upon one or more of the following grounds: (1) malconduct, fraud, or corruption on the part of an election official sufficient to change the result of the election; (2) when the person certified as elected or nominated is not qualified as required by law; (3) any corrupt practice as defined by law sufficient to change the results of the election.

(a) The application shall state in substance the basis of the belief that a mistake has been made, the particular election precinct or election district for which the recount is to be held, the particular office, proposition, or question for which the recount is to be held, and that the person making the application is a candidate or that the 10 persons making the application are qualified voters. The candidate or persons making the application shall designate by full name and mailing address two persons who shall represent the applicant and be present and assist during the recount. Any person may be named representative, including the candidate or any person signing the application. Applications by 10 qualified voters shall also include the designation of one of the number as chair. The candidate or persons making the application shall sign the application and shall print or type their full name and mailing address.

(b) Candidates, political parties, or organized groups having a direct interest in a recount and who are seeking to protect their interests during a recount may provide, at their own expense, two or more observers to witness the recount.

In conducting the recount, the director shall review all ballots, whether the ballots were counted at the precinct or by computer or by the district absentee counting board or the questioned ballot counting board, to determine which ballots, or part of ballots, were properly marked and which ballots are to be counted in the recount, and shall check the accuracy of the original count, the precinct certificate, and the review. The director shall count absentee ballots received before the completion of the recount. For administrative purposes, the director may join and include two or more applications in a single review and count of votes. The rules in AS 15.15.360 governing the counting of ballots shall be followed in the recount when a ballot is challenged on the basis of a question regarding the voter's intent to vote for the candidate, proposition, or question. The ballots and other election material must remain in the custody of the director during the recount, and the highest degree of care shall be exercised to protect the ballots against alteration or mutilation. The recount shall be completed within 10 days. The director may employ additional personnel necessary to assist in the recount.

The application must include a deposit in cash, by certified check, or by bond with a surety approved by the director. The amount of the deposit is $300 for each precinct, $750 for each house district, and $10,000 for the entire state. If the recount includes an office for which candidates received a tie vote, or the difference between the number of votes cast was 20 or less or was less than .5 percent of the total number of votes cast for the two candidates for the contested office, or a question or proposition for which there was a tie vote on the issue, or the difference between the number of votes cast in favor of or opposed to the issue was 20 or less or was less than.5 percent of the total votes cast in favor of or opposed to the issue, the application need not include a deposit, and the state shall bear the cost of the recount. If, on the recount, a candidate other than the candidate who received the original election certificate is declared elected, or if the vote on recount is determined to be four percent or more in excess of the vote reported by the state review for the candidate applying for the recount or in favor of or opposed to the question or proposition as stated in the application, the entire deposit shall be refunded. If the entire deposit is not refunded, the director shall refund any money remaining after the cost of the recount has been paid from the deposit.

If after a recount and appeal two or more candidates tie in having the highest number of votes for the same office, the director shall notify the candidates who are tied. The director shall notify the candidates of a reasonably suitable time and place to determine the successful candidate by lot. After the determination has been made by lot, the director shall so certify.

We’re done with the Anchorage count for today, although Anchorage questioned ballots (at least about 3,000) and a small number of Anchorage absentees remain to be counted on a later day. Most the Mat-Su absentees have also been counted as part of today’s tally, although there an additional at least 1,200 questioned ballots from Mat-Su to be counted on a later day.

Juneau started counting at 1 p.m. and we should be getting its results soon. Fairbanks will start counting at 3 p.m

200 More good news for Miller:

5:54pm: In the comments, trhawk notes that it looks like the absentees from Anchorage HDs 27-32 have already reported, and possibly were bundled into the Mat-Su valley results. Murkowski won those HDs by nearly 55% on e-day, and if their absentees were lumped in with the Mat-Su update, that would explain why Murkowski appeared have run so much stronger in those Miller-friendly areas. Meanwhile, the ADN reports that Anchorage is done for the day, although 3000 questioned ballots and a "small number" of absentees remain to be counted there. The next round of votes to be counted will come from Juneau, followed by Fairbanks later in the evening.

When you take into account Murkowski's willingness to cheat, this race isn't tight at all.  Basically, it's all over.  Murkowski will be the nominee, and the Communist/Democrat candidate will win.  A dejected GOP won't even show up to the polls, and the Dems will keep both houses of Congress.  David Frum will become the de facto leader of the GOP, the GOP will fold on every issue, and the Demoncrats will turn the formerly great America into a Communist nation, with 19th century technology per cap and tax, and a powerful, violent AFL-CIO controlling every workplace.  The de facto second-class citizenship of white males will become official, with Mexican Communist criminals streaming over the border in an orgy of rape and murder.  All dissenting views will be shut down per the Fairness Doctrine.  The Communist regime will literally last till the end of time.

Ray of sunshine that one. And I thought I  devolved into paranoid "all is lost" at the drop of hat; oh no, nothing on you.

I agree with Mr Paramus that the count split will be 600ish votes, and that if Murky decides to go to trial with this one, she shaves about 300-400, worst case 500 votes off of that making it a close loss.

Anything more would just cause more trouble for the "establishment" than help.

There is a lot of anticipation at the Division of Elections for the next round of numbers to come in. Those votes will be from Southeast Alaska (where the Murkowski campaign hopes to get a big boost) and from the Kenai Peninsula. There are a lot of absentee votes in those areas to be counted today (roughly 2,000 from Southeast and 2,300 or so from the Kenai.)

There are also 1,013 questioned ballots supposed to be counted today from Southeast and 502 from the Kenai Peninsula.

Murkowski needs to do well in the Juneau-Kenai results (which are reported together.) That’s because the next and final round of results today will come from the Fairbanks area, a Joe Miller stronghold.

There are 1,768 absentees and 996 questioned ballots supposed to be counted today from the Fairbanks area.

All these numbers of ballots to be counted are somewhat of a moving target. The Division of Elections can delay the count of ballots that it plans to do today until later days.

The Division of Elections said by the end of the day it will have counted about 16,000 votes.

There are another 9,000 or so to be processed for subsequent counts on Friday and Sept. 8. But those numbers will change as new absentees come in and some ballots are disqualified. Also, not all ballots are for the Republican primary. Some will be for the Democratic primary.

356 Again, from the ADN Comments

We told Lisa that if she ignored the people in those areas most affected by S.881, we would rise up against her and put her where she belongs, out of office.

Well, it may not have happened yet, but if she had listened to and cared about her constituents instead of trying to trade away our livelihoods and the land we need to subsist on she would not be biting her nails right now sweating about the outcome from the yet uncounted ballots....... You brought this on yourself Lisa.

The S 881 is legislation that gives land (back) to the Aleuts/Indians - which had the coincidental effect of pissing off the non-Aleuts/Indiants.  And, those people vote. in droves.

There's some talk aobut votes coming in from island districts that would be pro-Murkowski based on the  S881 legislation.  Also, the military vote is thought to be skewed towards Miller, given his service record.

362 There's nothing sinister about the missing Laurel/Dowling votes.  They never showed up on the precinct-level tally sheet on election day night.  The votes are in, and Murkowski only netted another 25 votes from that precinct, 176-151.  That's pretty much in line with the other precincts in the House District (HD 30).  They likely were included in one of today's three absentee vote dumps - but I'm not sure which.

No other precinct was completely missing on election day.

One thing to always keep in mind - when someone quotes the total number of votes to be counted, they also include Democratic primary votes.  75% Republican primary-25% Democratic primary seems to be the typical breakdown.

The good news is that state law requires the election be certified no more than 15 days after Election Day, counting be damned.  The bad news is that either candidate or a committee of any 10 voters can ask for a recount (if the margin is close enough, the State will pay for it;  otherwise the petitioner(s) must).

Kind of funny how no voter in the US seems to have standing to force proof that all candidates on a ballot are eligible (even though this should cost nothing and happened when some were known to have been ineligible and others were known to have never proven their eligibility), but forcing a recount in any Alaskan election, which costs real money, is easy ...

O/T: Christmas comes early.

Cops: Calif doctor gets stuck in chimney, dies

BAKERSFIELD, Calif. – A doctor involved in an "on-again, off-again" relationship apparently tried to force her way into her boyfriend's home by sliding down the chimney, police said Tuesday. Her decomposing body was found there three days later.

Dr. Jacquelyn Kotarac, 49, first tried to get into the house with a shovel, then climbed a ladder to the roof last Wednesday night, removed the chimney cap and slid feet first down the flue, Bakersfield police Sgt. Mary DeGeare said.

While she was trying to break in, the man she was pursuing escaped unnoticed from another exit "to avoid a confrontation," authorities said.

DeGeare said the two were in an "on-again, off-again" relationship.

The man's identity was not revealed by police, but the man who resides in the home is William Moodie. He declined to comment when reached Tuesday by The Associated Press, saying police instructed him not to discuss the matter.

Kotarac apparently died in the chimney, but her body was not discovered until a house-sitter noticed a stench and fluids coming from the fireplace Saturday, according to a police statement. The house-sitter and her son investigated with a flashlight and found Kotarac dead, wedged about two feet above the top of the interior fireplace opening.

Firefighters spent five hours late Saturday dismantling the chimney and flue from outside the home to extract Kotarac's body, DeGeare said.

Officials said Kotarac's office staff reported her missing two days prior when she failed to show for work. Her car and belongings remained near the man's house.

A cause of death has not been determined, and an autopsy was scheduled for Tuesday. Foul play is not suspected, though investigators have been looking into the incident as suspicious.

Sources in Alaska have informed Big Government that the trend in the count of absentee ballots makes it virtually impossible that Sen. Murkowski will overtake Joe Miller in the GOP Senate Primary. A trusted and well-placed operative told BG:

    It’s over.

Sources have also revealed that the Murkowski campaign is scheduling a conference call this afternoon (Alaska time) with her entire campaign team to discuss next steps. There is additional information we hope to be able to publicize soon. Stay tuned for updates.

Wait!  Wait!  Can't we talk about this first?

Make it be so. Years of emailing Murk about my concerns is very close to being over. I have a feeling I won't have to write Miller all that much except to thank him.

The fact that Obama has started talking about having to show his birth certificate means that it is finally getting on his nerves.  Apparently when he was enormously popular, the Birthers were a useful foil for painting the Republican Party as unhinged -- but now that he's not all that well-liked, he's worried that more and more people might give a second thought to questions about his origins, upbringing, faith and ideology.  So now he has to act quickly to quash all those untoward rumors, instead of relishing them as political levers.

GnuBreed,

The problem is that Christine O'Donnell is a fraud who's using her continual campaigns to pay her rent (when she decides she actually wishes to pay it).

The only person who ever said Castle would switch was Erick Erickson and it was pure bullshit fed to him by O'Donnell people that he lapped up like Andi Sullivan laps up man juice.

405 By all accounts, Miller has won the primary. Now we just have to hope that he doesn't have too many decomposing bodies stashed in his cellar. It would take a doozy of a fuck-up to lose in Alaska, but I'm always a bit wary of newbies. One old tape of him saying something disqualifyingly stupid and we all lose.

Posted by: Lincolntf at August 31, 2010 02:12 PM (hV/FZ)

406 To show the real story you need to see that trend as a function of election precinct counts and the remaining vote count. Murky is in real trouble without some real homerun precincts - and I don't think she has any left.

421 Ugh God when will Erick Ericksons bullshit rumor of a party switch die? It now has legs and the screaming morons at HotAir are now saying "yeah hes denying it but so did CRIST! OMGZ SO THEY ARE ALL GOING TO DO IT LOLZ 1111ELEVENTY1" HERE is the FULL BULLSHIT LIE that Erick Erickson posted: "There are "sources" (my quotes mine) that he is negotiating a deal with Beau Biden to hand over controls to him and to retire from office midterm. O'Donnell is doing better in polling and beating Coons, Castle isnt". Now, if you really buy that line of bullshit you have to ignore the fact that Beau COULD HAVE RAN AND WON IN A WALK WITH HIS LAST NAME, but decided to pass. NO SINGLE POLL EVER SHOWED ODONNELL CLEARLY BEATING COONS and showed Castle losing. All of the polling shows what most of us with half a brain know- O'Donnell is a pariah and a charlatan and Castle has NEVER lost a single election he declared for. LASTLY THIS CAME FROM ERICK ERICKSON. Those 3 irrefutable tidbits kill the rumor, and if you are still believing it I haz videoz on the internets you need to see about 9/11 and flouride...

Posted by: CAC at August 31, 2010 02:27 PM (lV4Fs)

422

Yeah that's the other thing. There was never any polling that showed she did "better" than Castle, there was one poll that showed her ahead (by two points). That was over a month ago and every poll before and after has showed her getting her ass handed to her (yet again).

Whereabouts in Alaska are you? How's the weather? The place has always fascinated me. In my dreams I purchase a summer home on the beach in Yakutat.

I wonder... we have a cat that's partially blind and has a recurring cough, but is otherwise pretty healthy.  She has difficulty with her litter box habits -- maybe she'd be happier there?  Hard to tell, given how many other kitties there are and whether she'd be able to socialize.

427 Miller lost 2 votes after the questioned votes from some Southeast and Kenai precincts reported.  The very good news is that the questioned votes there more or less followed the election day percentages.  If that holds, Murkowski is toast.  She needs a stellar showing in the Southeast/Kenai absentee count in order to have any chance.

It's almost pudding time.
