Trump: I Don't Want to Wait For Any Fancy-Pants Due Process Hearings Before Taking Guns Away from the Mentally Ill
Or Did He Say That?

— Ace

Note to Trump: Courts are pretty fast about processing temporary restraining orders and if there's genuine evidence that someone is mentally ill or a threat to himself or others, that evidence will be readily presentable to the court.

There is, therefore, no need to take someone's guns away -- to take someone's constitutional rights as a citizen away -- without even a court hearing (which tends to be biased in favor of granting restraining orders in the first place).

If there's no readily-presentable evidence that someone is making threats or mentally insane, maybe that's precisely the situation in which you'd want to be slow and deliberate about branding someone a sub-citizen.

The most embarrassing part is that he said this nonsense to Pence, who tried to steer him back into a defensible place, but Trump kind of just ignored his Vice President and went back to his grab-the-guns talking point anyway.

Alternative Take! Someone I trust saw this exchange in a different way. She sees Trump's reference to "due process in the courts" as a reference to a full hearing (up to an including a criminal trial), and that what Trump was trying to say -- inelegantly and maladroitly -- is that we need Gun Violence Restraining Orders as a speedier stop-gap.

Taken this way, Trump was agreeing with the idea of GVRO, and his reference to not needing "due process" was intended to mean that sometimes we need intervention before a full criminal trial. But at a speedier restraining order hearing which would involve "due process," but wouldn't be as lengthy and as long-awaited as a criminal trial.

He just put it, well, poorly. But in this interpretation, he wasn't saying we don't need "due process" at a TRO hearing; he meant we needed TROs until the full due process hearing of a criminal trial.

This explanation would explain why Pence did not appear flummoxed by Trump's comment -- he just took Trump's comment as agreeing with his own, if in a somewhat Trumpian locution.

98 GVROs have the potential for major misuse. If they're anything like domestic violence TROs the due process is minimal throughout the proceedings and courts routinely rubber stamp them because judges don't want to be known as being friendly to potential abusers. Plus, we already have procedures for involuntary commitment for the dangerous mentally ill on short notice. Why just take away guns via a GVRO but leave the dangerous person on the street to find another way to engage in mayhem?

99 We just got out of an 8 year relationship with a silver-tongued demagogue who brutalized our rights. Right now we're beginning the second year of a relationship with a leaden-tongued brute whose actions, so far, have been to champion our rights.

I'm more interested in what is done, than in what is said.

Posted by: JackStraw at February 28, 2018 07:49 PM JackStraw, have you seen that video of Mike Pompeo on stage with Leon Panetta, with Pompeo saying that "we" (CIA? 109 Manchin is gonna put his name on *another* "gun control" bill, in an election year???  Wow.  Does he have an opponent - I mean a functional effective one?  Trump won WV by like 459%, the governor switched parties to GOP last year.  How the H can Manchin survive?

Then again - quick, name the big 4 votes in the Senate since Trump was elected that are national issue, nationalized election material.

Trick question!  Aside from the scandalously failed O-care repeal, there's nothing.  GOP doesn't do "politics" any more.  So - very few votes, nobody ever walking the plank, nada.

In'shallah circumstances and fundamentals bring the election to the GOP, since the GOP (and WH) seem unlikely to actually campaign for it.  Odds are good, but no way to run a railroad.

I know it's on the forms you fill out where I guess you're supposed to be honest, but isn't a charge going to appear in the records check done (in the case of Virginia) by the state police? How hard would it be to add POTENTIALLY INSANE to the records the cops check? At the same time of the hearing, couldn't the judge just instruct the cops to collect the person's weapons? I'm not a big fan of people losing their rights on heresy, but it seems like the system is already in place.

185 One of the most powerful things the IRS can do is SIEZE your property and it is then up to you to prove why you should have it back. It's a rather tough burden of proof obviously. I don't think this approach is necessarily a bad thing, if the later hearing is legit. But does anyone trust that it would be? Does anyone trust that the courts coule easily find a way to side with the government just about ALL THE TIME. That being said, we do have to have a way to keep guns out of the hands of people whose state of mind is dangerous. I just wish I trusted the system better. This is kind of where faith and credibility in institutions and the rule of law is important. And we just don't have a lot of that right now.

192 GVROs in Cali allow someone's guns to be taken away with only minimal penalties for lying (e.g. committing perjury) on the forms. Thus in cases like divorces, they can be used as weapons against a party just like other TROs with little risk to those abusing them. In the meantime the one whom the TRO was issued to has to wait at least a couple of weeks for the hearing.

Feinstein was recently repudiated by the CA Dem Party, who refused to endorse her for the 2018 CA  US Senate race.  The consensus was that she's too old and TOO CENTRIST for California voters.  She'd have to do something ... something ... radical to get the Dems onboard.  And Manchin signing on to anything that even sounds like gun-control will end his political career in WV.   Trump knew what he was doing.

264 One, Trump never speaks precisely. So parsing what he says is worthless. It's all about the context of his entire statement. Two, just because he essentially taunts the Democrats to put forward a bill means nothing because you know they will go up to and beyond confiscation. 265 Manchin's 2013 background-check bill fiasco is part of his current term's resume. Manchin is NOW in real political trouble and the 2013 bill is part of his problem. Do you understand that much? Do you think after his 2013 gun debacle that he wants another chance at the brass ring? Donny Two Scoops wants a GOP senator in Manchin's seat after November. Posted by: mrp at February 28, 2018 08:29 PM (Pqytn) ___ Sigh. Manchin already said he wants to revive his 2013 bill and bring it up for a vote in 2018. This was before Trump played his 17D chess today. Manchin is a gun grabber. And Trump gave Manchin the thumbs up today. Why is this so hard for some of you to comprehend? And if Manchin is truly in trouble as everyone here seem to think, then he has nothing to lose with this. Remember the most dangerous politician is a lame duck politician.

270 Meh, I'm not worried.  Trump has a certain style.  He throws out a lot of stuff that doesn't mean much, to see what churns the waters.  And he sounds like he's agreeing to what his opponents want, which seems to lure them into demonstrating that they're not acting in good faith and just want the wedge issue.  See also: DACA.  Sure, he want's a deal on dreamers... just as soon as Congress passes it.  Congress, of course, isn't about to pass any amnesty for dreamers.  Hence, Trump can now say, "I was willing to compromise, but they weren't."

If I read correctly, he's also taken a much more gun-friendly stance on concealed carry, and we've heard him advocate for arming teachers.

294 Guys, really. Trump has spent a week listening to parents, students, LEO's and governors talk about how if they have a family member with a severe mental or behavioral issue , they can't get mental health professionals, schools, or the local police to do anything LEGALLY to either incarcerate the person, or stop them from obtaining weapons. All of these school shooting stories have the same root problem, kids with severe issues who the system keeps passing on for reasons of either apathy or worse, monetary gain such as Trayvon or the Parkland shooter. Because their are rules, programs, and sometimes laws in the way prohibiting them from getting anywhere. Instead of people here looking at this as a way to positively approach this problem, immediately everyone jumps to some bizarre conclusion that nosy neighbors will call the cops and have your guns confiscated as you are coming home from the range. Even though you have done nothing violent, threatening , or have any history of mental illness. There is about of mile of distance between a 18 year old who is online threatening to shoot his classmates and has a blog describing how IED's are made, and has had the cops called by his family members 40 times in the past 9 years and Mr. blog commenter with his 12 gauge under the bed that few know about.

Any owners 18-20 have to get rid of them. Gun dealer state licensing that should hurt if not eliminate most table top to small storefront FFLs. 3 day waiting period on semi autos Bump stock ban as class x felony Still to be heard, and most onerous, is a magazine/body armor ban that will turn anyone with a magazine over 10 rounds into a felon. This will likely come up tomorrow or Thursday and is the real bad one. The others passed by at least 10 votes. I can live with the others but this one must be killed. My R state rep voted for all of the passed ones so far. The senate is even less gun favorable, and Rauner caved on both govt. funded abortions and sanctuary state so my veto hopes are up in the air. I called the rep and submitted withness silps on the bills but a lot of gun owners in the state are asleep or too frickin complacent. 332 If I read correctly, he's also taken a much more gun-friendly stance on concealed carry, and we've heard him advocate for arming teachers. Posted by: Colorado Alex In Exile at February 28, 2018 08:35 PM (LrbFI) Trump has had a conceal carry permit, from NYC of all places, for years. He is a life member of the NRA. Don Jr. and Eric are both avid gun collectors besides active hunters. Trump told us at the NRA convention in 2016 when he was campaigning that he wouldn't hesitate to shoot anyone "coming at him". He then said that the SS had told him he could not carry anymore for obvious reasons, LOL. Someone upthread or last thread said Trump doesn't know much about guns. He's not a gunsmith, but he's not ignorant of them either.

I'm thinking about sending him my MAGA hat (that I never wore) back with the note:

Here you can have this back, I'm sure you can find another fool to buy it.

Good luck with that impeachment hearing in 2019 cause I won't be voting for any GOP this year.

Signed: XXXXXX

He can't walk this one back and no one can claim he's psyching the Dems or that he's playing 3d chess or something.

He's buried the School safety provisions and ignored concealed carry. If this does reach a reconciliation conference they'll probably have a "comprehensive" back ground check provision which means a national registry which is a total no go for most gun owners.

And if this thing doesn't get passed he's still betrayed us and can't be trusted.

All you folks thought he would surrender before he was elected. Apparently you were off by 2 years.

He's surrendered NOW. He started with DACA in January.

I think he was waiting for the investigation to get to the point where he was safe and now he can be him self.

Good luck Don. You'll need it.

Schumer, who couldn't hardly be bothered to stop at Graham's coffin today as he was grinning and almost back slapping Franklin Graham today after which he rushed by the coffin., already is pulling all the gun bills out of the same drawer they pulled Obamacare out of. The same worn out crap. The only thing today did was wake up the base that they might want to pay attention to their local elections this summer and fall, and start supporting conservative candidates for this fall. If the Senate or House goes to the Dems, you can look for an avalanche of these types of bills.

I actually bought a bottle of the gel solution for a Guardia Civil M1916 Mauser in 7.62. It has some pits and areas of corrosion on the barrel and I thought I'd try the stuff out (haven't gotten around to it yet, though). I picked it because it supposedly has a phospating effect on rusted areas, meaning it actually imparts some corrosion  protection unlike most other cold bluing solutions. I've also heard that you can pretreat rusted areas with phosphoric acid for added protection. As far as finishes go: It's like any other finish - surface prep is all important.

422 378- Posted by: Quint at February 28, 2018 08:22 PM ) You
better have a court and judge similar to FISA, or actually much more
stringent and fair, and then, you may have something. And even then, you
better have a strict limitation, such as 48hrs. or something, then
review.

I wouldn't pretend to know how the courts actually work or should
work. What you say sounds quite reasonable to me. I may have missed some
context, but I was thinking in terms of a guy like the recent shooter,
with red flags all over the place. Was there not enough evidence there
for a 'competency' (probably not the right word, here) hearing? Cuz to
me he seems like a glaringly obvious nutter, so if that isn't enough to
have folks saying "maybe this guy doesn't need to be packin", then
there really isn't anything to do BUT strap iron and pray. Which might
be excellent policy in general, but dead bodies are a sub-optimal
outcome.

Posted by: qixlqatl at February 28, 2018 09:03 PM (oKgIR)
I agree Qix, there should be a mechanism to do that. Someone should have stepped in with this guy. Also, I don't know the courts either, just a laymen's opinion. Yes we want to stop the bad guy, and we also want to prevent abuses. In my experience, government tends to make new laws that later have severe repercussions.

Posted by: quint at February 28, 2018 09:12 PM (n13/j)

And to be clear, no new laws were needed to stop this guy.  The government/police failed in this case, they did not need a new law.  That is something bureaucrats always do, they ask for a new law to cover up their past failings.

Posted by: Sebastian Melmoth at February 28, 2018 09:18 PM (2DOZq) I will be if there's anything actually in writing saying take guns but never due process. Or due process months from now. But what Trump said is more or less how it works now. Here's the deal (and as always this is very general and depends on jurisdiction): Right now, when a DV TRO (domestic violence temporary restraining order) is issued ex parte (issued by a judge without there being a hearing at which the defendant is present ie ex = without parte = party), when that order is issued the order will contain within it a direction to the police to take all the defendant's guns. So when the defendant gets served, the cops take the guns. Then, depending on jurisdiction, anywhere from 5-10 days later, there is a hearing at which the defendant is present to determine if the TRO will stay in place. So, yeah, due process has already been somewhat trampled upon when the TRO is initially issued. I believe the proposed GVRO follows pretty much those steps. So this isn't anything new. Whether it's wise is a separate question, but it's not new.

485 Yeah, I remember Trump talking about guns and the "mentally ill" during his campaign. His view pretty much mirrors mine, which is that you can have some issues and seek treatment for them, and this should not disqualify you from gun ownership. It's only actual full-on potentially violent psychos who should be forbidden from gun ownership based on psychiatric analysis.

I mean, hey, we all have problems, and I don't want people who would really benefit from having a prescription or two to be afraid to seek out that help for fear of getting onto a "no guns" list.

504 I will be if there's anything actually in writing saying take guns but never due process. Posted by: alexthechick - Breathe. Namaste. Prayer hands. Trump is cornered right now. We are barely 14 days beyond 17 dead kids and unfortunately much of America wants to "do something" about this. If the Left makes him the face of the anti gun safety movement then every shooting after this one (and there will be more - local school districts and sheriff depts seem to be guaranteeing it) becomes his, and his presidency gets that much harder.

He didn't get where he has gotten now - successfully governing as roughly the most conservative anti-liberal president of our lives by not knowing what he's doing, so for the moment I will continue trusting him to keep fighting for us. You may not have noticed he is practically the only one.

Posted by: Bikini atoll at February 28, 2018 09:42 PM (9tO1t) The problem is that there are no consequences for when people file false claims. You can, in theory (and depending on jurisdiction), file a civil action for abuse of process but there really do need to be charges brought for perjury for when women, and it's nearly 100% women, file false affidavits in support of the TROs. Posted by: alexthechick - Breathe. Namaste. Prayer hands. Warrior stance. at February 28, 2018 09:45 PM (dEQP3) ------ Yep. This was also done to me in order to deny access to my two daughters for a period of time. A purely spiteful action, which my attorney crushed in court. It backfired on the spawn of Satan at the final divorce hearing, and also allowed me to deny alimony, because the Judge could see what I was dealing with. Crazy Ex's. The gift that keeps on giving.

The notion of The Anti-Hero ? It wasn't new. Dutch Mantell and Bill Dundee both played that shit to the hilt in Memphis. Butch Reed was popular as Hell in Mid-South. The fans made The Road Warriors faces until the promoters just finally friggin' gave in. The NWA made The Midnight Express faces for what ... about five minutes ... before the fans gobbled it up ? The "BirdMan" ... KoKo Ware ... popular as shit in Memphis. Great athlete. Could work Face or Heel. Didn't matter - fans filled the stands. Because he was genuine and didn't follow the stupid Pure as the Driven Snow script. Worked an awesome 60 Minute match with Flair. Loved the Attitude Era. Only WWF era that I followed.

587 In contrast to the Fla. and Sandy Hook local PD's (and Dems across the country) He is suggesting using "Prosecutorial Discretion" and NOT just waiving opportunities to disarm dangerous individuals at Domestic Violence and Terroristic threat of  harm to self or others Police Calls/Visits. In numerous instances with many of these shooters the police declined to arrest, charge or disarm because the "Family" asked them not to. "Now that you have settled him down..can't we just handle it from here?", "He is facing enough challenges as it is being....(a psycho, violent, out of controlled temper)...special needs individual ..and all". Even a misdemeanor DV or any mental stay longer than 72hrs will generate a red flag hold on future weapons purchases(rescindable later if needs be and warranted) The Broward County Airport gunman just last year had his gun taken away by three separate agencies...who ALL later gave it back to him, before he ever arrived in Fla (PS: how did he get a Fla drivers license when he had NEVER lived there). The cops allowed the Cruz Family to have some third party come and "Hold" a number of the Fla Shooters guns...AFTER they had called the police to come and disarm the guy.

588 Red dog, that's the problem when you can only treat or confine with a punitive process that should be humane and medical. I am certain that's just what happened with the mentally ill Georgia teacher who today brandished and fired ( out the window) a pistol he may or may not have acquired legally. He's has multiple "kook" calls...at least two, one in which he confessed to a murder that was apparently a psychotic delusion, and a suicidal state of mind... It's going to turn out that while often functional, he's had "out there" events that those with closer contact knew all about...and probably hid, so that he could keep working as a public school teacher with direct contact with students
