Trump: Flag Burning Should be Illegal, Maybe Punished by a Year in Jail or Forfeiture of Citizenship
— Ace

The media is screaming about this, but failing to note that Hillary Clinton proposed outlawing flag burning in 2005.

Below, Chris Cuomo lectures a Trump aide on the unconstitutionality of anti-flag-burning laws -- completely forgetting that he notoriously claimed that a "Chaplinsky rule" in the Constitution made it okey-dokey to criminalize speech if it offended someone.

It's amazing that this illiterate dum-dum dares to lecture people on what the Constitution says. He's so damn smug in his towering ignorance.

Update: AllahPundit notes that a lot of Trump defenders are offering (as we once did for Bush) a lot of 11th-dimensional chess-type explanations for Trump's outburst, claiming he's playing the long game from wicked angles you can't even see -- trying to deflect from this, prepare the battlespace for that, and generally troll and bait his opponents into making some sort of error.

The most obvious explanation (which Allah notes) is that Trump saw something on "the shows" about flag-burning, decided he didn't like it on a purely gut level, and tossed out his tweet to the world.

Well, it turns out that Trump tweeted at about the time FoxNews had on a segment about flag-burning.

Now, I don't buy the "Trying to Deflect from News He Doesn't Want You to Pay Attention To" explanation (given that a much simpler explanation exists and accords with what was on TV at the time). But it's wrong to say there's no bad news to deflect attention away from -- probably.

Chris Christie is giving a press announcement today, without taking any questions from the media.

I am guessing -- without knowing -- that this has something to do with Bridgegate, or simply noting that he's decided not to seek re-election in 2017.

Eh, would Trump care about that? Probably not really. Still, it does seem there is likely to be some indirectly-affecting-Trump bad news later.

59 is it too early to go off topic? I didn't want to post this on the open thread because I though it would be missed by most. from yahoo news, if you can call it that: Amid widespread protests and worrying signs of dysfunction in the administration of President-elect Donald Trump, millions across the United States are likely wondering how, or if, it's possible to oust the billionaire from the White House before the 2020 presidential election. While there have long been talks of impeachment hearings, a favorite theory this week for removing Trump from power involves the 25th amendment to the Constitution. [what signs of dysfunction? Not nominating Robert Reich to be Secretary of the Treasury? And the last paragraph, oh my: after an explanation of how the president can be removed without impeachment: the EXPERT speaks!] Liberal "GQ" correspondent Keith Olbermann called it an instant impeachment, a sort-of "crazy-man clause." "For my money, he's nuts - couldn't pass a sanity test, open book," Olbermann said. "But of course, Section Four of the 25th Amendment here does not say 'nuts' - or impaired, or erratic or unbalanced or unhealthy or bipolar or narcissist or sociopath or psychopath. I suggest that we legalize the burning of flags.  I also suggest that we statutorily set the penalty for beating the living crap out of a flag-burner as a fine of $1.00.

This was changed by a 5-4 decision by the Supreme Court... effectively taking all questions of citizenship away from the Congress... even though that power is explicitly granted to Congress... Almost every major social / legal screwup we have, can be laid at the feet, of the Supreme Court.

It so happened that one night a reporter caught up with a Marine who was standing on the edge of the dance floor, checking out the talent, and asked him what stars he was hoping to meet. "Bette Davis," was the instant answer. "Oh, she's your favorite?" the reporter asked. "Nope," the Marine grinned. "I just hear she fucks like a mink!"

149 I don't think that Trump is playing n-dimensional chess with the media here. The simplest explanation is most likely the right one. Trump says things impulsively. He said that flag burning should be illegal because he thought that. Lots of people think the same way. Some of us are free speech absolutists, but the average LIV doesn't have enough principles to stand up for something they don't like. So the media is now yelling about how totalitarian Trump is in an aspect that I'd wager way over half the counter would agree is ok to be totalitarian in. Because Trump is Wrong, according to the media, everything he says must be wrong, even the stuff that's popular. In this instance, I happen to think he's wrong, but this isn't going to hurt him because I know i'm in the minority here.

Can we ban all diversity officers/officers/policies/claptrap?

Or at least withhold all federal funds to universities that employ such creatures?

166 I would suggest it 2/3rds of STATE Legislatures pass a bill over riding a Supreme Court Decision, it is over turned... (note, this is the same bar as a Constitutional Amendment) Posted by: Don Q. at November 29, 2016 12:16 PM (qf6WZ) SCOTUS has gotten so used to being the Final Arbiter of All Things that I'll bet if this amendment were passed, it would somehow be declared "unconstitutional". Seriously. Nobody ever gives up power voluntarily. Except for Augusto Pinochet. But he doesn't count, because he was a monster. I know this, because that's what th4e NY Times said.

I am guessing -- without knowing -- that this has something to do with Bridgegate, or simply noting that he's decided not to seek re-election in 2017.

Eh, would Trump care about that? Probably not really.

Surely in 150 comments, someone's pointed out that Christie may be blowing up sufficiently that he's off the transition team, which Trump might care about.

"I share your feelings about flag burning scum" is probably the more likely explanation, though.

177 I was raised by braindamaged leftists. I've lived through the past 8 years. This stuff doesn't even register with me anymore as something whose ramifications should be worried about. The counterargument is usually, "but if you allow this, then the left will try to...". F*ck that STUPID argument. The left already has been trying to shut down free speech anyway. At this point it is idiotic to have scruples about fighting according to the rules, because the left has discarded all pretense in caring about rules or universally applicable moral principles. When you are faced with a lawless sociopathic adversary, it's perfectly moral to hobble them by any means. As a comparison, it's normally illegal to use lethal force, but if someone invades your home and threatens your life, it is perfectly acceptable. "Fair play" or "normal social conventions" doesn't enter into the picture.

202 Eh, I think Trump's just going with his gut here, although politically it makes sense to further divide his supporters from the Democrats who will be forced to defend the act in the hedging way they do. It makes the Trump party the American party, and the opposition something other (of course, except for the fact that most of the Republicans asked so far have said that it's a protected First Amendment activity).

But it's not smart in the context of knowing he'll soon be making at least one appointment to SCOTUS, and you can be sure that the questions about flag burning are already in the hopper because of Trump's tweet.

240 Althouse linked to a story about a Trump "thank-you" tour. One of her commenters suggested that this might be the reason for the tweet: to encourage the anti-Trump left to show up and burn flags in protest where all the cameras can see them. You know this is actually very plausible to me. Not 11 dimension chess, just living in their little pointy heads.

241 >> "I just named two cabinet members that will help us >> overturn Obamacare. Can we talk about that? Just >> please, whatever you do, don't make me talk about >> flag burning!" The flag-burning thing is misdirection. It's "Look, I hate what these people are doing" but no one (sane) ever expects criminal sanction for it no matter what he says. And it makes the usual hoo-hahs on the other side jump up and down for a while and make themselves annoying. Trump really needs to just say "When I tweet a smiley can you idiots all get red-faced for a while so we can hate you more?"

From an ijr article: According to Flags Unlimited, the significance of the flag's colors is this: The Blue represents the officer and the courage they find deep inside when faced with insurmountable odds. The Black background was designed as a constant reminder of our fallen brother and sister officers. Thin Blue Line USA has more details on the line itself: The Thin Blue Line represents the relationship of the police in the community as the protectors of the citizenry from the criminal element. It represents those men and women that are willing to give their life for the peace and harmony of the community they serve. To be an officer, it is no easy task. Everyday brings on new challenges, yet new opportunities do arise. You make arrests, patrol the streets, and do what no other citizen will ever do. You are the Thin Blue Line that will always stand strong, united, and exhibit true strength from within. The line featured on the flag is a concept that has been around since 1988.

And let's see how it plays in Washington, at the inauguration, when flag-burnings are used in anti-Trump parties on inauguration eve, and the next day. I want the MFM to "celebrate" all this, with their descriptions using "mostly peaceful," and "dissent."

248 Sloppy analogy and analysis. Defense of Trump=The defense of Bush. First, Trump isn't even President yet. Hate Bush or like Bush--people could follow the logic of Bush. Bush was a sitting war time President during the most devastating attack on the USA CONUS. And, during a new era of terrorism that didn't follow previous nation state norms. You've borrowed a lot of enemies for Trump. Mitt Romney Republicans, Bush Republicans, Cruz Republicans, Reagan Republicans. That brings up another point. Bush was attacked for being a RINO because of spending. Spending to get the nation back on track after the devastation of 9/11 and two of the worst national disasters. He also did a pharmaceutical benefit and that was to try to keep seniors on board and voting Republican during a war but also as a compromise to stave off HillaryCare which later morphed into ObamaCare. In fact many of the same bloggers extolled the wins of supposed Jacksonian Democrats--ala Jim Webb because everyone stupidly believed that Democrats suddenly cared about deficits--Jim Webb never once stood up against any of Obama's Cash for Clunkers or multibillion dollar stimulus plans--he should go down as one of the biggest liars in current history. Now Trump's Organization is telling people that he has a huge infrastructure spending plan and that was hardly debated during the primary. In fact when spending ideas were talked about on the campaign trail by Trump--he would get upset that people didn't cheer enough and then tell them if they didn't cheer louder he might not spend money on their local infrastructure. The Trump Organization is telling everyone it is now--The Trump Party. What does that get you? The guy is old--once he dies what happens? Does it get you a Cult of Personality like Obama's? How did that work out for Obama? The Democrat party is decimated. The Democrats got rid of--and refused to work with Blue Dog Democrats. That didn't work out too well now did it? The Trump Organization--while history does not repeat itself--it does rhyme--and they are making almost the same pattern of mistakes.

288 The most obvious explanation (which Allah notes) is that Trump saw something on "the shows" about flag-burning, decided he didn't like it on a purely gut level, and tossed out his tweet to the world. ----------------------------------------------------------- Allahpundit has been wrong about almost everything for the last two years. Why did Trump do it? Prime immediate reason number one: He is trying to bait the left into a flag burning rampage, which will once again draw people to Trump, not the reverse, and at the lest get a big thumbs up from his supporters. He does get off baiting people, so if there is a "gut level" it is that, not what AP thinks. Trump may say and do stupid things sometimes, but the idea that Trump just does this because he sees some news story and decided to tweet it goes against the accumulated evidence we have seen the last two years out of Trump. But there are other reasons... Trump has been rather silent on Twitter until the last couple of days. Then he broke out about illegals voting in the election (granted partly in response to Hillary wanting a recount), then this about burning the American flag. Combined with the fact that a Jihadist, who was a refugee from Somalia, went on a rampage at Ohio State yesterday. Remember Steve Bannon is with Trump now, so are a few other people who would not mind seeing the left get over aggressive and confrontational in a mass freak out. Everyone in the end needs a "Casus belli"...even Trump & Co. Note: Personally I am not against this either. The left has spent years trying to bait conservatives, our military, and anyone who actually loves this country into doing stupid idiotic things. I think our side has done a remarkable job not taking the bait. Lets see if the left has that kind of patience.

Posted by: teej at November 29, 2016 12:35 PM (JEx0Z) I was in hs - an all girls Catholic hs - back when streaking was a thing. One fine spring day, three guys from the nearby all boys Catholic hs, ran into our cafeteria, buck nekkid except for ski masks (and one guy had tied a blue ribbon around his dong, which was a nice touch). They ran the length of the cafeteria to much applause and delight and ran back out again. It was well planned, because they were never caught. I thought the old nuns would have grand mal seizures.

Ironically, Trump's bold statement against American-Flag burning to the point of criminal penalty is non-controversial.

Of course the country should adamantly defend the utmost symbol of the country within the the laws of the country itself.
It's only pointy-headed, "abstract"-thinking intellectuals that have clogged up the path to this obvious commonsense.

That said, it is very likely Team Trump has stridently chosen to take a non-controversial position on a topic that is bound to arouse ire and consternation from the Democratics and the Media who stupidly will stupidly see his position as stupid.

Sharp move. All hail Trump.

President Obama's legacy is tarnished by the fact that his programs and policies failed across the board, everywhere.  Obama is obsessed with his legacy yet can't point to a single noteworthy accomplishment.

I personally think tax breaks for infrastructure spending are a good idea, but that isn't really what you're talking about.   What you're talking about the detrimental effect 'personality cult' type of thinking has on political parties.  Truth is, Obama had the Democrats completely under his control.  No one can say the same thing about Trump and the GOP.   Comes to that, Ronald Reagan caught all kinds of shit from both the Rockefeller Republicans and the far-right while he was President.

We're Republicans.  We don't do personality cults.

Posted by: Sebastian Melmoth at November 29, 2016 12:45 PM (AEEhl) And it wasn't too long ago, the Stalwart Republicans were debating a Constitutional Amendment to outlaw flag burning. 376 "In fact, many of Trump's stated positions on a range of issues are to the frigging left of Paul Ryan." To the left of Ryan in theory, or to the left of Ryan in practice? Ryan has a history of shoving through leftist policies while simultaneously claiming he's staunchly upholding rightist orthodoxies. In the last "cromnibus" bill, Ryan relieved Big Labor of a terrible self-inflicted headache. To wit, repealing the "Cadillac taxes" about to be levied on their health insurance by Obamacare. Ryan described this as a "key conservative victory". So: expending political capital to ride to the rescue of a key Democratic constituency, to help them out with leftist legislation they found painful, and that they had originally supported, while removing them as a bloc of support for eventual attempts to repeal that legislation (since it no longer hurts them). You be the judge! Is this, in clear speaking and common sense, an actual advancement for the right, as Ryan says it was?

423 The American Flag is not just a piece of colored cloth. It is a legal item. The flag serves legal purposes - which is why ships fly a flag and why planting a flag on property serves for a determination of ownership. Being a legal item - an item that serves very important and serious legal purposes - there is no great argument that it should be allowed to be burned just to express some hate for America. If one is so determined to show how much they loathe the United States then they can burn a picture of a bald eagle or something similar. They can burn an effigy of the President. They can burn and destroy all sorts of things. But they cannot burn an American Flag. If they tried to burn dollars they would find themselves immediately open to serious jail time. The flag is more important and integral than federal reserve notes.

And I've been a Boy Scout leader for 24 years and have taught 100's of Scouts how to respect the flag (including burning it in a dignified fashion when it is too damaged for further display). But respect coerced is not respect, it is fear. If we are to preserve freedom and liberty and the concepts of private property, then burning a flag in protest must be legal (however reprehensible the act may be).

435 "Not 11 dimension chess, just living in their little pointy heads."

True story: Many years ago, during the Reagan administration, I was chatting with a co-working who was a foam-flecked-lips leftist. I happened to mention a news item (I forget what, exactly) and said that I'd seen it in the Washington Times. My co-worker's face screwed up in rage and disdain, when I corrected myself and said that the story had appeared in the Washington Post; and his face immediately relaxed into an expression of benign acceptance. The change was so striking that, just for grins, I said that no, I was right the first time, it was the Times: and his face immediately reverted to the expression of rage. And then I again reversed myself and said, Oops! My bad - it was the Post, and his expression relaxed again.

I swear to you, I did this three more times, and each time it was like seeing one of Pavlov's dogs react to the bell: Washington Times, rage; Washington Post, smiles. Never mind the content of the story: its origin was enough to trigger the reaction.

That was the last day that I took the Left - or a political fanatic of any stripe - seriously.

As for Trump, he's not playing 11-dimensional chess: trolling fanatics doesn't require subtlety.
