As Doc_0 notes, the retirement of justices isn't a black swan event that just snuck up on the NeverTrump Super-Cons. Not only do actuarial tables combined with a basic understanding of How Time Works suggest that 3-4 justices will retire over the course of Trump's two (or more...?) terms, but we knew for a fact the next president would appoint at least one justice, given that Antonin Scalia died months before the election.

And yet: This seems to have completely blindsided the very important people who tweet on twitter all day long about how fucking smart they all are.

Should these "influencers" continue to influence?

Steve Hayward continues. Twitter formatting stripped out for your reading convenience.

I'm not saying it was tantamount to an endorsement of Hillary, although hardcore NeverTrumpers did do that, and they're currently rooting for Dems to take over Congress. But if you'll indulge me for a few tweets, this is the thing about conservatives and 2016 that still bugs me.

I'm all in favor of vigorously contested primaries. I didn't vote for Trump myself, and he wasn't in my top 3. I got some angry feedback when I wrote highly of other candidates. I'd have no inherent problem with people supporting a primary challenger to him in 2020.

But at some point the primary is over, and the election absolutely does become a binary choice, with gigantic stakes given the size of government, power of SCOTUS, etc. I deeply wish the stakes were lower and elections were less important, but they're not.

When Trump secured the nomination, Republicans - especially politicians, writers, pundits - either decided the stakes were high enough to support him despite his flaws as the underdog in a tough and important election, or they decided opposing him was worth President Hillary.

There is a fantasy about the "third option" of staying home that needs to be put to bed forever. That's not how it works. You stay home and the Democrat gets half a step closer to winning.

Now, if you thought the stakes were low enough that either actively helping Clinton win or passively allowing it were acceptable courses of action, then fair enough... but it's disingenuous to change your mind now and say, "Wow, SCOTUS is really important."

We knew that in 2016, and it was pretty clear several SCOTUS nominations were on the table, one of them PROMINENTLY so. We knew what would happen if Clinton locked in a far-left SCOTUS for a generation.

This is important because we're talking about the judgment of prominent pundits and politicians, people who (at least in theory) hold significant sway over public opinion. They told us to trust them last time as they took a position that would have put Clinton in the White House.

I'm glad if they've seen the light, but I'm sorry, I just can't cut that much slack for seeing a light that should have been as obvious as the rising sun in 2016. The retirement of aging SCOTUS judges is not a black swan event.

When it really mattered, when the chips were down and the Republican nominee needed all the help he could get to win the longest long-shot victory in recent memory, there are people who went AWOL or actively supported the Democrat.

No, I don't want to "dump" on them and I don't spend time needling them. (The clowns who are still trying to give Congress to the Dems are another matter.) But a higher standard must be set for the political judgment of influential people.

And for what it's worth, I felt the same way about those who judged it preferable to toss 2008 to Obama instead of supporting squishy McCain, or bailed on Romney in 2012. How did that work out for you, guys? Still think giving Obama the White House was a small price to pay?

The fact is that the stakes are so high, we're so close to crossing so many lines, the Democrats are so aggressive about using power, that I don't think any presidential or congressional term can be sacrificed even for sincere long-term plans to improve the GOP.

I understood all of that in 2016. I'm pleased to see conservatives who didn't coming around. I welcome them one and all. But if they're prominent and influential, it still matters that they made different calculations in 2016, and will ask their audience to trust them again. /end

And then there's Maude:

Notice the hedging: He wants to deliver a scorching-hot hot-take announcing his opposition to any Trump nominee, but he doesn't have the stones to fully take off the mask.

This guy's such a coward he can't even suck a dick without being mealy-mouthed about it.

Though Cap'n Bill does begin scheming about how to block a conservative justice:

6 Ben Shapiro aka Bill Kristol Jr. once declared that He would never ever vote for Donald Trump because he would not appoint conservative Supreme Court Justices. Now that smarmy little shit is tweeting at Trump that he could be on the SCOTUS for decades if Trump picked him. Guess the little cuck wants to self fulfill his prophecy.

People gain influence by exercising judgment that is borne out over time; they saw further than others, and were right before others realized the best course of action. These assholes were wrong, and maintained a flawed position, even after it was obvious that they were wrong. In a parliamentary democracy, they'd be pushed out forthwith as PM on a vote of no confidence. As they should be here.

75 The fact that its such a huge issue who gets to be the next Supreme Court justice is just painfully obvious proof at how overly important and powerful the court has made its self over the decades. I mean, partly its the left having the vapors over everything to a degree only seen in meth-addicted manic depressives, but its also the overly powerful state of the judiciary. And the best way to dial that back is a court strongly dominated (like 6-3 or more) with judges who will rule strictly and carefully by the constitution, rolling back the excesseses of previous courts, and weakening their position. I honestly don't see that happening, I fear how far the left will go to prevent it. There is literally no scenario or horror that they could try that is off the table. A nuke in a major city isn't too far for them to consider.

84 O/TBTW, was going to post on last thread, regarding Jewish Fried Chicken...
Used some matzo meal mixed with salt, pepper, dried onion/parsley, paprika, cayenne, Italian seasoning etc., fried in olive oil and baked with cheese on top, served with a tomato-caper sauce. Know it's not kosher but was 100% delicious. Old hotness = breadcrumbs. New hotness = matzo.

He is supposed to supply political commentary with a conservative slant and he can't even manage that. Little old uneducated deplorable me knew that it was a change election and the right Repub could win it. But it had to be someone that didn't rely on the donors or the media to do it. Trump was the only person to fit that criteria. And Trump has proven that the economy works best when you have someone as President that understands what makes the economy work.

It always falls in one of those two categories. I really, REALLY hope LePage primaries her next go around.

One hand you have the smooth ideological boys who could only vote for Clinton because Trump is so uncouth.

That's the whole lib MO - whip people into an emotional frenzy over everything, find the injustice over expired milk and manipulate emotions to get the desired outcome, irrespective of facts or reason.
I have a dear friend who is a democrat, and she wants people to be safe. And happy. And provided for. Well intentioned, sure, but personal responsibility is not in her equation really, nor is how much someone else's responsibility extends to another person you're not related to. Fire and safety as a shared part of the community, I get that. Providing unrepentant hard core addicts with injection sites and low barrier shelters... yeah, I'm not interested.

She still can't quite figure out how I'm a great person she loves and trusts but I am not a democrat. I see how easily she gets manipulated and influenced by the democrat talking points as opposed to her own principles or moral compass. I think her moral compass IS the democrat party and their talking points because she is convinced of their good intentions.
You can't reason with that, and unfortunately, those people still vote.

Posted by: pep at June 28, 2018 08:30 PM (T6t7i) IMO, he's way past Lincoln already. Outrageous? Here's why I think that. Lincoln had the Civil War thrust upon him, and after a lot of fits and starts, stepping on his dick, and a lot of roughing up of the Bills of Rights, he eventually prevailed. He had precisely zero impact on world affairs. None, whatsoever. Trump is already having a huge impact on world affairs (never mind domestic affairs). The nasty situation in North Korea may (MAY) come to a happy and peaceful resolution, thanks to his efforts. The mullahs in Iran, are shitting bricks, and may well face their Ceausceau moment any day now owing to Trump's leadership (because the insurgents realize that Trump WILL support them, assuming they're not Islamic nutjobs). It's important to recognize first, that Lincoln is no BFD outside the United States. And second, he was widely regarded as a chimp - even by his own Cabinet, e.g., Seward - literally right up until he decided to take in "My American Cousin."

Washington is hard to top just because he's a towering almost mythic figure. I doubt anyone will do better, he's the Babe Ruth of presidents, the guy everyone is compared to.

201 And here's an example reported at Insty's just this morning by a critic replying to David Bernstein linking a WaPo report on Trump and SC nominations...

#NeverTrump
By David Bernstein; May 2, 2016

Republican presidential front-runner Donald Trump visited the editorial board of The Washington Post on Mar. 21. Here is audio of the full, unedited interview. (Gillian Brockell/The Washington Post)

I haven't blogged for a while, but I wanted to take this opportunity, with the Republican Party establishment increasingly slinking toward Trump, to express my solidarity with the NeverTrump movement.

The man is a crude charlatan, an ignoramus, a fraud, conducting a modern medicine show that combines the worst of politics with the worst of professional wrestling. He is a disaster for the Republican Party, limited government, (what remains of) decency in politics, the Constitution, and the country.

I'd rather Hillary Clinton win. I'd rather (and I never thought I'd say this) Barack Obama serve a third term. I'd even rather Bernie Sanders win, though if it came down to Sanders vs. Trump it might be time to form a breakaway republic. If Trump wins the nomination, I will actively seek to prevent him from becoming president.

I would support any of the Republican presidential candidates who ran in this election over Trump. If Trump wins a majority of the delegates, I will implore any delegates pledged to Trump to stay in their hotel rooms for the first ballot to deny him the nomination. Is that stealing the nomination from the voters? If it is, I don't care. Anything that's legal can and should be done to stop the disastrous Donald Trump.

I'm still hoping that Ted Cruz, or anyone other than Trump if Cruz falters, gets the nomination. Regardless, I and many others will not be sweet-talked, bribed, threatened, or scaremongered into supporting Donald Trump for president. Never, ever, Trump.

294 Comment 185: "He [Lincoln] had precisely zero impact on world affairs. None, whatsoever." In fact, Lincoln was able to keep the major European powers out of the Civil War. See this analysis for example regarding the U.K.: https://en.wikipedia.org/wiki/United_Kingdom_and_the_American_Civil_War Example: "Lincoln appointed Charles Francis Adams, Sr., as minister to Britain. An important part of his mission was to make clear to the British that the war was strictly an internal insurrection and afforded the Confederacy no rights under international law. Any movement by Britain to recognizing the Confederacy officially would be considered an unfriendly act toward the US. Seward's instructions to Adams included the suggestion that it should be made clear to Britain that a nation with widely scattered possessions, as well as a homeland that included Scotland and Ireland, should be very wary of "set[ting] a dangerous precedent.""

There have been guys who hit more home runs (with more games, mind you). There have been guys who pitched 20 win seasons. But there has only been one player in the history of baseball who hit more home runs in a season than every other team in baseball combined and who ALSO was a pitcher who threw three 20-win seasons in a row before becoming an outfielder. There's only one. No matter how good anyone gets in baseball, they'll never be better. Ever.

Washington was a demigod.  Even his contemporaries, no shrinking violets, acknowledged how crucial he was, how he was the necessary man who made all others fall back into the shadow of his selfless greatness.

Lincoln rose to the occasion, greatness was thrust upon him and he rose.  John Wilkes Booth was the worst calamity the South had to face.

The following essay by Webster Tarpley, tells about the largely untold alliance between President Abraham Lincoln and Russian Tsar Alexander II, which by many accounts was key to the North winning the U.S. Civil War, sealing the defeat of the British strategic design." 321 I am saddened to see Kennedy retire. Many people cheer his departure because he was an 'uncertain' vote in the directions they desired. In doing so, they abandon the very notion of an 'independent and ethical' court. In the mid-late 70's I was considering going to law school. I -very briefly - meet Kennedy at a social/recruitment thingee for McGeorge Law School, where he taught Constitutional law. I told him I was a 'very strict constitutionalist' and asked if he thought the legal profession had a place for me. He didn't answer me direct, instead he invited me to sit in on some of lectures and make my own decision. I did so, I came away with several conclusions: (1) Kennedy has an intellectual passion for not just the Constitution, but also the very concept of a Constitution as 'the law of the land". (2)'Strict Constitutionalist' is - in practice - a much more complex concept than the words imply. A 'Four Corners' test by the most reasonable people with the highest professional integrity will almost certainly result in differing opinions. (3) He held 'results oriented' Justices in disdain. Arriving at the 'correct' decision is far more important and critical than reaching the 'popular or fair' result. Political (read 'popular' or 'ideological') issues should be decided legislatively, not judicially. Over the years I've read Kennedy's decisions closely and concluded that the law professor I heard had stuck to his guns. Yes, he authored several controversial opinions. But he did so based on his scholarly assessment of 'the law' rather than a citizen's opinions of what 'ought to be right'. He is a very good writer and teacher. Reading his opinions is a fantastic education in 'Constitutiional' law. You may disagree with his results - but arguing with him on his grounds will lead to embarrassment: and maybe, just maybe, a better understanding of how this whole thing is 'supposed' to work. Apologies for the wall of text.

Most people know if they are not capable of controlling themselves or if they are really damaged their families know. Like Grant and Sherman who gave generous terms to the defeated armies, Lincoln would have been generous in rebuilding the South.  I think he would have done a Marshall Plan if he had lived.

Grant at Appomattox let the officers keep their personal weapons, let those who brought horses and mules to the army take them home, and distributed rations to the Confederates for the trip.  Sounds like he had a good idea what the government, i.e., Lincoln, wanted.

The fact that there is nothing written into the constitution regarding the process by which a state may leave suggests that the idea wasn't even part of their thinking. Now, personally I think that's a flaw, and there should be a process outlined and part of the constitution. An amendment would be a good idea. But its not there, and that does not in any way translate into "so you can just bail!" because that's not how countries work or have ever worked. The default inevitable position in all cases in history has been "you cannot just take part of our country and leave."

It's just a little hyperbole.  All of his contemporaries knew how necessary Washington's agreement to any national form of government was.  Nothing would be trusted if Washington did not put his endorsement on it.  That is just the way it was.

The Capitol rotunda, at the top, has The Apotheosis of Washington.  It is Washington ascending to the heavens and becoming a god.  It is not an ironic hipster joke, Washington had that place for a lot of people.

And my mockery is very gentle to what other people here have and continue to deliver.  I may not succeed always, but I try to be gentle to all, because hey - one day it could be me.

439 "280 >>Do you really believe if Merrick Garland's confirmation proceeded and went to a vote, he wouldn't get unanimous Republican support? But it didn't proceed and the reason is almost entirely because McConnell and to a lesser extent Grassley refused to let it go forward. ------- Kind of hard to hack on Republicans and not admit it was Republicans who not only blocked Garland but made a Supreme Court Justice seat a big election issue for Trump. Every now and then they do good and they've done awesome on judges at all levels. -------- Agreed. It really moderated my opinion about McConnell, whom I knew to be a clever tactician but never considered a particular ballsy guy. THAT was ballsy. I couldn't see Ryan showing that degree of courage. That may be wrong but anything remotely similar doesn't spring to mind. For the same reason it was critical Trump became president it is critical that the Senate remain in Republican hands. As things have unfolded, the USSC has an outsized, unjustifiable influence. It is what it is, and it's much better to be on this side of that reality.

440 I cannot imagine George Washington presiding over a Constitutional Convention that would create anything other than an indissolvable union of the states. Not after all he went through. To create a union where a state could blackmail the others with threats of secession when ever that state had a fit of pique about something? Then they may have well just kept the Articles of Confederation and gone back home. Posted by: Mikey NTH - The Outrage Outlet Brings You Inspector General and his Electric Accordian Band! at June 28, 2018 09:24 PM (0QYMt) First, was George Washington thought or didn't think is beside the point. If the union were to indissoluble, those entering in it needed that to be clearly stated. No small print, or secret codicils: if this is indissoluble, the states choosing to join needed to know that. And I notice no one has essayed an answer to the question of how this differs from Britain leaving the EU?

441 You don't have to be a Rhodes Scholar or a Jesuit to figure this out. In Oxford, Rhodes scholars are considered rah-rah dolts from the colonies. True story. Only here are they considered to be intelligent.

443 309 Posted by: Christopher R Taylor at June 28, 2018 08:40 PM (39g3+) Washington was a demigod. Posted by: Mikey NTH - The Outrage Outlet Brings You Inspector General and his Electric Accordian Band! at June 28, 2018 09:01 PM (0QYMt) ----- Washington was the great man of deeds. Lincoln of ideas. different gifts, but there at the right time.

445 Will the Soros clinton Arkansas mafia fixer squads institute emergency political equalizations on Conservative Supreme Court justices like they did on Scalia ?

446 The UK has a currency different than the Euro. Posted by: NaCly Dog at June 28, 2018 10:37 PM (hyuyC) Yes, they kept their own currency and did not convert to Euro currency. A few other countries also followed that route, iirc. For the ones that did convert to Euro, it makes leaving the EU much more difficult.

447 "And for what it's worth, I felt the same way about those who judged it preferable to toss 2008 to Obama instead of supporting squishy McCain, or bailed on Romney in 2012. How did that work out for you, guys?" Considering that ACA is pretty much killed, whereas McCain would have created something near as bad only with Republican fingerprints on it that the party would still be "compromising" with the Dems on fixing, Obama over McCain worked out fairly well. Sure, Obama nominated Sotomayer and Kagan, but we'd have to pretend that Chief RINO McCain would have done better. He might have, but I wouldn't have bet money on it.

448 He would support a primary challenge to PDT in 2020? Really? He would risk the SCOTUS nominees to someone else, when PDT has proven he picks honorable constitutionalists, when he has no idea who someone else might nominate? Again, a perfect example of our "elites" choosing style over substance. Forget the "elites", this is the time for Americans to take back our gov't without anyone's "help."

449 Saw McConnell on Fox tonight and have to admit I have a slight, growing, grudging admiration for the guy.  He hung tough on not giving Obama his pick (after the Left murdered Scalia - and I firmly believe that because I don't believe in coincidences) and says that Trump's nominee will get a vote before October.  I hope he delivers.

450 Late to the thread as usual, but....

I kinda remember the Nevers and others mocking we pragmatists who were heavily focused on SCOTUS during the campaign. They insisted that Trump would nominate a Souter at best, or would seriously nominate his sister, Ted Nugent, or some other ridiculous choice. And you know what? Any of them would be better than the arch-proggies that Hillary would have nominated. She would have dumped Garland too.

451 Have to say, Kristol's intransigence was a huge surprise to me. We all know what Trump said during "W's" administration. And then reality set in. People change. He wasn't my pick until he won the nomination. And voting for The Donald was a hell of a lot easier then voting for sleaze bag McCain.

452 What a stultifyingly stupid comment by Haywood. And how pray tell were we supposed to know those stakes? And knowing the stakes - this is the crucial part - so that means the country should not have elected Trump? Why does he think so many people voted for Trump? And yes we will take Justice Maybe over Justice Lefty. He claims he is not endorsing Hillary but of course he is. How stupid does he think we are? I have had my fill of how much the leftist intelligentsia tries to insult our collective intelligence.

453 I get from Doc Zero's writing that even though he didn't like Trump in the primaries, he supported him in the general if only because Trump's SCOTUS pick would be much better than Hillary's. And should people who did not grasp that be considered influential now? I get that - I didn't want Trump in the primaries either. I'm still not happy with the scorched earth treatment his Republican opponents got. That damages the brand for years to come. Doc Zero had some great conservative writing as a commenter (kind of a COB arrangement) in Hot Air's old green room, back when Michelle Malkin still ran the place. He got employment at a couple places I tend to not follow, but it's good to see his writing in public again. The green room posts are still archived, and they are still worth a read.

454 Exactly who is just figuring out NOW that they don't want NeverTrumpers as "thought leaders"? You have to be pretty solidly a cuck for that to be any sort of question.
