Of Course: Judge Decides She's Commander in Chief and Orders Military to Continue Recruiting Transgenders, Because We're Now In a Lawless War of All Against All
— Ace

It seems that judges should have some regard for the constitutional scheme of separation of powers, but apparently Social Justice imperatives trump any notion of democracy and lawful order.

The military must begin accepting transgender recruits Jan. 1 despite a ban ordered by President Trump this year, according to a D.C. district court judge.

Judge Colleen Kollar-Kotelly had already granted a preliminary injunction in the Doe v. Trump lawsuit filed by a group of transgender troops. She clarified this week that her order also blocks Defense Secretary Jim Mattis from delaying the recruiting.

Mattis had planned to begin accepting transgender recruits on the first of the year before Trump tweeted in July that they would not be allowed to serve in the military in any capacity. The president later followed up with an order telling the Pentagon to abandon the plan, which got underway during the previous administration.

"Secretary Mattis is a defendant in this case, he is directly bound by the injunction and he cannot change the policy that existed before President Trump issued his order," the judge said.

In other words, Obama's executive orders as president are still in force because this judge likes Obama better and elections don't matter.

I honestly don't see how the United States remains a coherent unified nation.

101 Koller-Kottely woman, along with hundreds of other Leftie judges, is determined to bring law into disrepute ========= Understand that your average leftist judge really believes that the law is what they say it is. They really believe they, as judges, exist to get the outcomes they desire. That is their function and prerogative as judge. Now, do they give any thought whatsoever to what the does to the population? I've seen no evidence of that over the course of decades. They appear to think of only the moment when they pull the lever of power and make something happen as they will it to happen. If it gets in the way of something they decide they want to do later, its no problem because their only rule of decision is "what do I want to do now".

103 I mean, it isn't a matter of daring them to enforce their ruling, but enforcing your own legal rulings. Or the people can take a more direct approach.

114 There's a transpyrsyn on one of my favorite forums. Came across as a nut *well before* identifying as "pansexual" with an alternate female persona, then later a garden-variety translesbian. Spent a whole lot of time stirring drama, doing "diaries", up and on with the me-me-me all the time, and a while back on this "tolerant" board overwhelmingly lefty board got trolled in textbook "transphobic" manner by someone... who the numbers game would indicate was still someone more left than LBJ. Okay then. No drama for a while, pyrsyn was persuaded to dial back the showboating, so then spent periodic posts "debunking" "trans myths". Recently had a completely unprovoked breakdown and flounce... Depression, unresolved issues, ongoing unaddressed dysfunction in real life - the whole mental illness matching baggage set. Where's my surprised face? I'm sure it was around here somewhere.

Isn't this just another way of getting them into a government paid for medical program?

They sign up, wash out and the VA gets to pay for their sex reassignment? Let the battle vets die, there are dicks that need choppin!
.
.
.Unless they somehow get into Combat real quick, the VA will not have anything to do with them if they get an Entry Level Separation (ELS) which happens with most mentally unstable people.  I was kicking out 2-3 dozen Recruits  a week when I was assigned to RTC Great Lakes on ELS's in the 1980s and the Navy isn't running anywhere near the numbers they were when I was stationed there.

Heck I was running about that number of Sub School washouts for drugs or mental at Groton CT in 1995-2012.  These people get weeded out way before they get to the Fleet in almost all cases.  Granted some sneak past, but not many and most of the ones who do manage to sneak past usually get dumped before they are able to reenlist.

I think everyone needs to understand that at most in the entire Military contrary to what the msm and liberals would have us believe we are talking about less than a couple of dozen people out of 2 million member Military.

158 I'm tempted to repeat ....... Judicial coup status: [X] Intact [ ] Other than intact But I've no idea of the legal situation here. Is there any statute mandating admission to the armed services for certain people, or any statute limiting the executive's setting standards for same? If not, then what is the possible basis for her order? Don't laugh. I was one who pointed out that the various travel ban rulings really broke new ground, in that they literally had no relation to any statute or other legal basis (leaving aside granting standing to people who simply don't like a lawfully adopted federal policy). The big problem with America the last few years is that parody, or arguing by reductio ad absurdum, has been rendered impossible. In this case, I think I even did joke in months past that the judicial lawlessness would only get some peoples' attention when they began to directly interfere in military matters, which almost everyone understands to be exclusively an executive arena, as limited funded and authorized by Congress.

166 *clambers up on soapbox* *dons jaunty tinfoil beanie now with propeller!* This is all a result of Congress deciding post WWII that it was going to cede out its authority to administrative agencies and the Court. Nearly, though not all, of the mischief that's occurred over the past 70 odd years is a result of Congress saying nah brah to exercising its authority. Congress has control of the courts under Article III but refuses to exercise it. The courts presume they are are more than merely another co-equal branch because the branch charged with reining in the courts refuses to do so because *hand wring* it's not my fault, the court made me do it and you believe in the rule of law, right? *hand wring* Same thing with regulations though this is a bad example since this is a legitimate exercise of Executive power. But let's swerve over to Net Neutrality. All of this insanity right now is over regulations, not any kind of legislative action. This craven refusal by Congress to protect vigorously its powers is, in my opinion, the key factor in why we are in the mess we are in politically at this moment. *surveys kingdom* Hmmm. Interesting. *jots notes*

299 alex as usual your macro view is correct, re congressional failure to play its proper role. But in this particular case I just don't understand the basis for an order. There's a lawsuit on the matter, and I don't understand the possible basis of that, either. In the travel cases, it was pretty clear the courts were just usurping executive (AND legislative) authority. In fact, they apparently have succeeded in doing so. The administration has been arguing with the courts in the completely lawless baseless terms the courts have invented for the case - about whether someone seeking admission has "ties to the country" etc. Ridiculous. The president's delegated authority in the matter is clear, and encompasses everything done in his initial EO. Not even arguable. It's THAT case where the president arguably violated his oath by complying with the court. This case remains murkier to me.

Banning the warring nations makes sense, but others must have some merit to earn them a place here.  And they have to accept our law (unlike that judge).  It is the globalists that want to break down the West with an invasion of foreigners, including jihadists.

324 I honestly don't see how the United States remains a coherent unified nation. Posted by: Ace at 04:15 PM --- Spoiler alert: It won't. The only question is what will be the precipitating event that leads to a National Divorce. I suspect it will be a catastrophic military defeat -- the loss of a carrier battle group in a conflict with China over Taiwan, probably. It would cause a national nervous breakdown, eventually causing different parts of the country to go their separate ways. A lot of people think this isn't possible because there are too many islands of blue in the sea of red, and pockets of red among the blue states, but I don't think that will ultimately be much of an issue. It will be remedied partially through large-scale population transfers, voluntary or otherwise; or else by folks deciding to switch their allegiance when they come to the realization that whatever their differences, they actually have a lot more in common with their neighbors than they originally thought. Such developments are not unknown in human history, so I have no idea why people think it can't happen again. You'll see some skirmishing over a few border regions coveted by both sides; some of these could even turn into low-level conflicts that drag on for centuries. I imagine the status of Chicago would be one of the biggest sticking points, as it's one of the crown jewels of blue America, but it's stuck in the middle of an ocean of red. But the broad outlines of the eventual division seem pretty clear. The only real question is how peaceful the settlement will be.

329 @209: "They control neither purse nor force. They are rightly the weakest of the branches."

Sorry, but we bitched both the Executive and Legislative branches.  McCullough/Marbury, baby.  The Supreme Court ruled that the Supreme Court rules, and the other two branches didn't say shit.

330 But, the current status quo is that they cannot join. ergo... by this order... it can't be changed. The current status quo is that things are to be changed in future, so despite the fact that there's a scheduled change to the status quo, and on changing it will no longer be a change in the future and that would be a change to the status quo, the status quo counts both as a change coming and a change having already taken place - or will once it takes place, which is due to the immutable characteristic of changes which once having happened have always happened. It makes sense if you don't think about it.

333 319 313 "Any action by any of the defendants that changes this status quo is preliminarily enjoined." ======== "Status quo". Liberals are so silly. I've seen this type of thing before. They pretend that their bozotic innovations of 5 minutes ago are the "status quo", a time honored tradition. This allows them to paint anyone who opposes them as a radical rightwinger, as if they were the ones trying to force some unprecedented, disruptive change on everyone. Yeah, the fight over who gets stuck with Chicago could be fierce. Downstate Illinois will fight like madmen to get rid of them...

338 If a higher court doesn't quash this within days, this lawless order should simply be ignored. Tell her to bring her army if she wants to enforce her personally preferred policies. Posted by: forest at November 30, 2017 04:18 PM (/1c+O) ======== Exactly. Let's say Jan 1 comes around, the case is still being tried or is in an appeals court, and Mattis ignores it. What is she going to do? Have Mattis arrested? I don't think so.

339 I for one am shocked that two Democratic politicians aren't willing to give up their very profitable careers just to keep Roy Moore out of the Senate.

342 She's 74 years old. Tick tock. It is remarkable how all that 'heroic rebel' stuff from the 1960s has become a giant pile of lawless progressive dog shit in practice. I guess in the end it was just paranoia and narcissism induced in suscepible individuals by heavy marijuana use.

352 Obama did this to turn the military into the largest provider of "free" sex-change operations. It would hamper readiness, cost billions, demoralize troops who do not wish to swear fealty to the New State Religion and generally degrade the military while mainstreaming perversion. A majority in the House of all the Democrats and 25 RINOs voted to support this. And the NIH is handing out grants to study how to best chemically-castrate healthy young boys, a War Crime of which Dr. Mengele would be proud.
