Mueller Examining Whether He Can Indict Trump For Obstruction of Justice Based On His... Public Tweets
— Open Blogger

Insulting his insubordinate subordinates on Twitter might now be a crime, Mueller has decided.

For years, President Trump has used Twitter as his go-to public relations weapon, mounting a barrage of attacks on celebrities and then political rivals even after advisers warned he could be creating legal problems for himself.

Those concerns now turn out to be well founded. The special counsel, Robert S. Mueller III, is scrutinizing tweets and negative statements from the president about Attorney General Jeff Sessions and the former F.B.I. director James B. Comey, according to three people briefed on the matter.

Several of the remarks came as Mr. Trump was also privately pressuring the men — both key witnesses in the inquiry — about the investigation, and Mr. Mueller is examining whether the actions add up to attempts to obstruct the investigation by both intimidating witnesses and pressuring senior law enforcement officials to tamp down the inquiry.

Mr. Mueller wants to question the president about the tweets. His interest in them is the latest addition to a range of presidential actions he is investigating as a possible obstruction case: private interactions with Mr. Comey, Mr. Sessions and other senior administration officials about the Russia inquiry; misleading White House statements; public attacks; and possible pardon offers to potential witnesses.

26 Trump getting indicted for obstruction [...] ++++ I don't think so. Mueller must be getting ready to wrap things up. His report will address all the various claims about Trump, like obstruction. To do that, he needs to examine stuff like tweets and Trumps motives in firing Comey. I'm guessing his report will say things like Trump is very disrespectful to certain norms, but that technically, there's no crime nor grounds for impeachment. Why else would he be looking at tweets, for heaven's sake? He can't actually be thinking of claiming criminal activity based on mean tweets.

53 Mueller is just buying time until late October. Then a week or so before the election he will drop a very weakly justifiable bombshell, a putrid ham sandwich if you will, too late to pursue via legal means but just in time to (try to) sway public opinion. Then Blue Wave. Then Impeachment. Then First Woman President. No, not that one. They'll run Comey.

Posted by: RogPodge at July 26, 2018 08:59 AM (EsHMF)

54 Basically a prosecutor can indict a ham sandwich and create novel legal theories and all it takes is getting buy in from a jury, the jury in this case is the House Democrats in charge of impeachment proceedings should they take the house in the mid-terms. Mueller already conjured the here to fore unheard of charge of Defrauding the United States in the Manefort travesty why not conjure the legal theory of Obstruction from public tweets.

105 I'm starting to think that what Mueller has in mind is to put out a report in October calling for Congress to impeach Trump. Mueller will say he can't indict Trump so here's what I would indict him on if I could. It will be short on substance but the other side won't care. At all. The message will be clear: Vote for Dems right now so we can rid ourselves of Trump. There's no other reason for Mueller to spin his wheels on this "obstruction" nonsense. He will say that Trump has frustrated his investigation, has tampered with witnesses (by publicly Tweeting), has hidden evidence (by not volunteering testimony), etc. It will be made-up crap but it will make the other side call for a revolution.

178 This President, as opposed to any ordinary citizen of the US or prior President, is not entitled to attorney client confidentiality. Trump, and "Associates" of Trump, are also not entitled to due process and can have his offices and those of his staff searched on a "general warrant" looking for any and all evidence, without probable cause. The FBI and CIA are apparently empowered to spy on US citizens, without a probable cause warrant, so long as the citizens are Donald Trump or his "associates" so long as they call it "counterintelligence" ( based on an uncorroborated document that is quoted in the news, because they leaked it to the news) Donald Trump personally is also apparently and uniquely not afforded protection by the First Amendment as to be able to make public statements about the central political controversy of the day. Article II of the Constitution apparently does not allow this President, in particular, to exercise Executive power, or even try to persuade people working for him, without threat, of the wisdom of not investigating a supposed crime which is neither a crime, and for which there is no evidence that the non-crime was committed by anyone in his Administration. In my pants.

If Sessions insisted on being a Boy Scout he should have gone one step further and resigned, clearing the way for a real AG.  By not doing so he's demonstrated that he's just a weak, frightened of his own shadow, little man.

363 I like the idea of impeaching Rosenpenis, but Dershowitz says it's a bad idea that will make impeachment of Trump more likely. So I'm not sure.

---------------

It might, it might not. No one knows what effect it would ultimately have. All I know is conventional wisdom is usually wrong. Doing the right thing is usually right. So impeach away.

If the end result of this is that it leads to more impeachments within the executive branch, then lets have it. Its a remedy that has been far underutilized.

367 If it's a guaranteed lock, why are people worried about losing the house? Its not always true, but often the party in power of the executive department loses seats in the legislative during off year elections. However that is typically associated with bad economic news or people's frustration with the president, and none of that is true this year. I would be very surprised if the GOP lost the house, but its not exactly unprecedented. The generosity was overwhelming, and I would like to thank everyone from the bottom of my heart. Glad to hear it, may God continue be with you and your family.

449 Allahpundit was never a conservative. What is and always has been is a militant atheist asshole. He came in after 9/11 because conservatives were the only ones who wanted to deal with the Muslim problem and provided him with a safe audience to vent his hatred for Islam (as a religion). Allah hates Muslims because it's a religion. He also hates Christians for the same reasons. Same story with Chris Hitchens (Allah's hero by the way he fangirled when Michelle Malkin got him an autographed copy of one of Hitchens' books). These people were only on our side as it pertained to the Muslim problem. Any port in a storm and all of that.

489 1. Obstruction of justice entails: a.) not being the subject of an investigation b.) lying to investigators to protect the target As to subhead a, Trump is CLEARLY the target of this investigation, and he has not been interviewed so it would be impossible to go after him for this. Besides, it has already been noted a sitting president can not be indicted. This is such a clownshow. Cursing these partisan bastards for attempting to launch a coup is in no way obstructing any investigation. I am thinking this thing is wrapping up. Posted by: Axeman at July 26, 2018 10:22 AM (vDqXW)

493 The President has power--he's supposed to have power. He's supposed to have ALL this power the DOJ and the know-nothings are STEALING from him. He is *vested* in all this power power. Therefore, it is likely that the President can intimidate almost anyone in government to some degree or other. If you are saying that exercising speech as the President of the United States is "intimidating" that's something, but the alternative is that the President of the United States has no right to free speech, simply because he's got a lot of power. This wasn't an established standard, so right now it appears, that they are trying to create an ex-post facto application--and I don't have confidence that they aren't going to try an end-run around standards of proof, where they would have no chance of success--to "evolving standards" where they can just make shit up.

Posted by: Axeman at July 26, 2018 10:22 AM (vDqXW)

494 For those with PACER accounts, you can look up the numbers of sealed actions before the courts. Whatever the numbers are, they are running far above average which is more or less 1000 in previous years etc.. Currently, the numbers in PACER currently are abnormally large numbers compared with past numbers. Now, from my understanding, there are a variety of sealed court proceedings, indictments, search warrants, etc. that these numbers may reflect. Some are probably related to human trafficking, some to gang activity such as MS 13, but some jurisdictions have provided a number of specifically sealed indictments that was unusual enough for local news to address it-e.g. Arkansas for example. It is clear for whatever reason, that the DOJ has taken up using secrecy to a greater extent in jurisdictions for court proceedings. What that means is unclear but it is unusual compared to past practice. ADA Huber exists but what he is doing, really no one with knowledge is talking. It is to be noted that large server farms such as the NSA's Utah Data Center are in this jurisdiction. Facebook and others internet giants also operate server farms in this state. Regarding Sessions and Rosenstein, part of the issue was the recusal and Sessions will probably get fired for it sooner or later. Rosenstein is a complicated case as he is involved in the Uranium 1 scandal, the FISA scandal, etc. Second, for whatever reason, Republicans, particularly in the Senate, still support him. I suspect that corruption among the gang of eight and the Senate Intelligence Committee has something to do with that. Code breaking and intercepts has been a U.S. strategic strength dating back to WWII, I'd imagine that some of the flip flopping comes from the collateral damage to real programs of national importance that revealing the whole extent of misuse of intercepts for political (and perhaps financial) reasons. The misuse of government contractors to access such data has long been a problem with Snowden, etc. demonstrating that outsourcing such things compromises security. I also suspect that the Five Eyes group has been used in a round about way to use other countries to spy on U.S. citizens and pass that information to U.S. authorities thus avoiding any oversight. I also suspect that is why Trump dislikes May who was PM during at least some of the shenanigans of spying on the Trump campaign. It is clear that the national security and law enforcement institutions have malignant cancerous growths--a political tumor if you will. How to excise the tumor without killing healthy function is a difficult task, perhaps made worse by hacks such as Sessions, Wray, and Rosenstein. What can the average Joe do about it, work your friends and neighbors into supporting Republican candidates for office.

Keeping that in mind, I think Allah's behaving like a swamp creature. Its refreshing to see Ace at least recognizing when something directed to POTUS is bullshit. Those of us who supported other candidates in the primaries (I was a Cruz guy, for example) but pulled the lever for Trump (SCOTUS, SCOTUS, SCOTUS, folks) are able to get past dislike for the guy and recognize the corrupt attacks. Why can't the nevertrupers? Also: Never EVER forget, that before Trump, the Media/Elite complex that cried wolf told us Romney, McCain, and Bush 2 were all "NAZIS OMG THE WORST EVAH" again and again and again. Knowing that they would have continued that shrieking against any GOP candidate, I personally take some pleasure watching them getting gored by Trump's bull in a china shop approach. Its like the voters basically said. "Oh, Romney is a Nazi, huh? Evil and all that. OK, hold our beers and watch this." Its glorious, except to watch people who ought to know better behaving as Allahpundit is doing now. Its bad enough to have the Nevertrumpers who are just obtuse or perhaps craven. But most of the Nevertrumpers are not thick, or slow witted, or fearful of the state of the discourse among the body politic. What they are is worse. They'd rather burn down their own political ideology, put themselves and their point of view in the wilderness for decades, than see someone who is not in their club winning. Very sad.
