Report: Rod Rosenstein Threatend to Subpeona Emails and Phone Records of Congressional Lawmakers and Staffers Seeking Information About the Origins of the Russia Probe
— Open Blogger

I'm sure Bill Kristol and his Democrat allies and backers will be up in arms about this "norm-breaking" exercise of anti-democratic, anti-transparency tyrannical executive power.

Oh wait -- no they won't.

Catherine Herridge reports:

Deputy Attorney General Rod Rosenstein threatened to "subpoena" emails, phone records and other documents from lawmakers and staff on a Republican-led House committee during a tense meeting earlier this year, according to emails reviewed by Fox News documenting the encounter and reflecting what aides described as a "personal attack."

The emails memorialized a January 2018 closed-door meeting involving senior FBI and Justice Department officials as well as members of the House Intelligence Committee. The account claimed Rosenstein threatened to turn the tables on the committee's inquiries regarding the Russia probe.

"The DAG [Deputy Attorney General Rosenstein] criticized the Committee for sending our requests in writing and was further critical of the Committee’s request to have DOJ/FBI do the same when responding," the committee's then-senior counsel for counterterrorism Kash Patel wrote to the House Office of General Counsel. "Going so far as to say that if the Committee likes being litigators, then 'we [DOJ] too [are] litigators, and we will subpoena your records and your emails,' referring to HPSCI [House Permanent Select Committee on Intelligence] and Congress overall."

A second House committee staffer at the meeting backed up Patel's account, writing: "Let me just add that watching the Deputy Attorney General launch a sustained personal attack against a congressional staffer in retaliation for vigorous oversight was astonishing and disheartening. ... Also, having the nation’s #1 (for these matters) law enforcement officer threaten to 'subpoena your calls and emails' was downright chilling."

Threatening Congressmen with subpoenas to stop them from conducting their lawful, constitutional oversight function sounds like obstruction of justice to me.

And it's grounds for firing.

44 Obstruction? Sure. Also, though, those congressmen have the right to subpoena anything they want (though they might not always get it). Layer on some "Deprivation Of Rights Under Color Of Law" to the mix, too. In fact, I want these democracy subverters to all be charged with that. They are trying to execute a coup, which disrupts our representative republic. Charge the entire central core (Rosenstein, Mueller, Clapper, etc.) with 340,000,000 counts each. If convicted, sentences are to be served consecutively.

Iranian officials admitted last week in a groundbreaking interview that their government helped obfuscate and cover the tracks of al Qaeda militants who eventually went on to carry out the 9/11 attacks.

Lately (for weeks) it was "Dr. Krang" leaving oblique troll comments alleging ("positively!") that Trump had a "feminine nature", and when people didn't bite on that, he went to another schtick, got banned, went back to "Dr. Krang", finally had some people bite, got banned, and this morning was on a "Orange Grandpa Cuck" or some such nonsense kick. Most of his mistakes have been bringing in people who turned out to be wolves in sheep clothing or not up to the task at hand. Fortunately, he's not afraid to get rid of them. I still remember how unpopular Donald Rumsfeld got and Bush waited until right after getting shellacked in a mid term election to fire the guy. Maybe it wouldn't have made a difference, but it sure looked bad. Trump seems more willing to get rid of people. I'm more forgiving of any of Trump's errors because I knew this would happen when he won. I knew GOPe would stonewall him at every turn and that he'd be taking serious flak from the media and Dems.

227 Trump could fire a bunch of them when the time is right ... Nixon did it poorly ... but others have done it successfully.  (or so I read, it is not so rare)

It is a lawless coup ... but we see Trump's approval numbers improve as Mueller and Rosie get exposed as criminals covering up for criminals.  I hope there is a master plan ... and we/they are working off that.  I'd still say the Sessions stand down is NOT part of the plan ... but we are combining legal action with the need for a PsyOp flipping of the NationalZeitgeist ... with crazies like DeNiro or RosieO losing their minds and going primal scream for all to see.

Sea change ... there's a storm coming ... We Are the Storm.

There are people who work in the Senate and House who committed and abetted actual crimes and are now very scared. Those people want to stop these investigations at all costs. I can't say exactly why Rosenstein is withholding information, but I think it's a big mistake to assume that "Congress" is a singular entity fighting against the Man for Justice. As a businessman (*the* businessman), Trump was probably used to one thing: loyalty. The top chiefs in a company are usually loyal to the boss, or they move on somewhere else. Very rarely do they try to usurp. It is not so with politics. The top chiefs are often usurpers in government. I think Trump wasn't prepared for that, coming from a place with rules. He seems to have picked up on it quickly, though, and terminated those who needed terminating - thus his record-breaking firing rate at the beginning while he was figuring it out. I do think he was caught flat-footed by disloyalty in politics, but figured it out.

350 Just a reminder that regardless of what the media says Congress does not have a right to every bit of evidence the DOJ might have uncovered. Exceptions to the rule include any information that is being used in a criminal case or has been presented to a grand jury. There is now proof of what has been pretty obvious for some time now, there is a grand jury empaneled in this case hearing evidence. Don't know if that's the case here but if you read the article, I know that's a big ask, the Congressional staffer admits deep in the article that Rosenstein was likely reacting to Congressional threats to subpoena him and if so this really is noting more than dueling shots across the bow. Trump can fire anyone in the Executive branch he wants at any time. He can also declassify any information he wants at any time. He hasn't done either in this case and the story is 6 months old. IG report will be out on Thursday afternoon. Expect to see more bullshit stories between now and then trying to get people distracted.

POTUS is head of the Executive Branch. Period. All executive power is vested in that office. He can go up their asses with a microscope if he wants to. Levin's idea was for Trump to task an existing US Attorney (so he would already be confirmed as a principal officer) and give the task of cleaning them out. Just give him the task, and all access to everything, and tell him to let the chips fall where they may. And throw all their asses in jail for their crimes.

361 I keep on thinking of the Mel Gibson movie, Conspiracy Theory. Mel kept on talking about the different factions of the government, I guess he would call it the Deep State today, and about how they were at war with each other sometimes, but then they seemed to be working together at others. Then you have this story today, contrasted with this story at CTH. https://theconservativetreehouse.com/2018/06/08/the- bigger-story-behind-the-james-wolfe-indictment/ That's about the Senate Intelligence Committee staffer who was arrested for leaking to the press. Along with well reasoned speculation about actual Senators who were also illegally leaking. So, we have elements of the DOJ/FBI after Senators for criminality, plus Senate committees after elements of the DOJ/FBI covering up possible criminality by some of their own. Both sides using lawfare, intelligence shenanigans, media leaks, etc, against each other. It made more sense in the movie.

371 You have to remember, things like prosecutions aren't handled by one person. It takes a team, and communications among that team. I can't say that letting Mueller and Rosenstein go crazy is the President's greatest idea ever, because these are corrupt shitbags who will absolutely burn down American law to keep their power. But we've had to keep the Trump Crazy Stages in mind: 1) TRUMP IS HITLER! 2) Trump is incompetent! 3) Trump is meaaaaaan. 4) Okay, he's really not that bad. yes, or that they are in the cabal, working with the DeepState honchos (oligarchs, red diaper babies) that actually HAVE been running our government.

so if a congressman exposes the criminal activity inside the IC, the IC has six ways from Sunday to (crimainally) get you back, for exposing their mafia.

what else can that mean?  Congress has oversight, but the FBI/CIA has been threatening (and carrying out action on those threats, malicious prosecution, illegal spying, murder?) ... threatening any that dare expose their crimes.

But Hillary walks free, and in thei face of dirty cops covering up, they organize a coup, and "punish" all that were involved with Trump winning.

Firing ... yeah.  Prison ... yeah.  HANGING ... that is the most appropriate for such treason.  55 million died in WW2 cuz of flucks like these mobsters.  We can nip it in the bud ... expose them, hang the worst of them, confiscate the wealth of those that funded the treasonous/seditious takeover  ... that's all.

381 By the way reading the book Wise Guys (which the film Goodfellas was based on) you learn that Billy Batts wasn't just beat to death because he annoyed the psychotic Tommy DiVito character. See, Batts was in charge of all the operations and areas that "Gentleman" Jimmy Conway (DeNiro's character) ran while he was away in prison. When Batts came back, he just assumed he'd get them all back. And Billy Batts was made, while Jimmy was not. So he should have and would have. But instead, Jimmy Conway and Tommy DiVito killed the guy and buried him in the woods and the rest is pretty much how it happened. The "Gentleman" in his name was one of those ironic nicknames like calling the fattest guy in the group "slim." He was the terrifying psychotic monster in the group, he'd murder you at the drop of a hat, friend or enemy (you get a glimpse of that after the Lufthansa heist where Jimmy pretty much kills everyone who was supposed to get a cut).

Edgar Hoover, there would be no shilly shallying around about "threatening to subpena" stuff. Old J. Edgar would have pulled out a couple of photos--this Committee Chair in bed with two gay guys in a threesome, receipts for jewelry that the next Committee Chair bought for his mistress; a couple of fraudulent tax returns; photos of some of the staff weenies buying crack cocaine etc. Subpenas? That's kid stuff. For entertainment J. Edgar could have played the tapes recorded in a mattress sandwich--Martin Luther King on top, Maxine Waters in the middle (she was bertter looking back in the day) and J Edgar's microphones and tape recorder on the bottom. Rosenstein--you're a pathetic rookie.

462 She's got her own web site, I see: http://www.abigailshapirosoprano.com/ So she's Ben's little sis, then. She's hot, I'll have to say, but a ball gag would be mandatory. If shrieks out with that voice, my Lord, it could cause penile fracture.

463 I don't understand NeverTrump at this point. I kinda got it during the primaries. He's loud, he's a reality television star, he's not serious, etc. But now? He's fulfilled more campaign promises than anyone in my lifetime. Even if he didn't pull them off, he's tried to fulfill many more. He made a list of judges and promised to nominate one of them from the list...and he did. If he pulls off North Korea, he's going to be more popular than Reagan. You really have to wonder if it comes down to a personality failure in that they want to keep losing to Democrats.

476 Congress can **find** someone in contempt. Yeah. That's all they can really do, though. They can't actually punish them or enforce any sort of penalty.

477 "I don't understand NeverTrump at this point." Because you keep putting "YOUR" filter on them. Your premise is wrong from the get go that's why it doesn't make sense to you. If somebody is nice to you and is smiling and friendly while they weld an ax at you the action is telling you that your assumption that this is a nice person not out to hurt me is WRONG. It's called cognitive dissonance. You keep trying to hold two opposite views at the same time and still keep coming up empty. The answer, spoiler alert: is that they were never on your side. How many times do they have to show you themselves with the masks off before you believe them?

I have heard that the emperor penguin flocks in Antarctica have been infiltrated. We need someone with Rosenstein's abilities to go under cover with them to find the infiltrators. Like last week even.

491 Article II is very clear on whether the Executive or Judiciary can harass Congress about their lawmaking: they "...shall not be questioned in any other place". If he were to simply interview them about the conduct of their legislative duties, he would be in violation of at minimum the plain text of the constitution. Let alone a subpoena. I don't know what kind of spaghetti the Supreme Court has twisted this clause into, though. This is very, very clearly and directly related to their legislative duties. At minimum, it would be clearly and explicitly unconstitutional for him to subpoena those records.

492 I rise to vigorously oppose the Sessionsfluffers---you don't joke about having a firearm or a bomb at airport security;.. You don't threaten to supoaena the records of representatives of the people -as retaliation for something you don't like. Rosenstein needs to be removed (Sessions at least--and easily---demote him for his remarks)from his position for a number of reasons but this threat would be high on the list for reasons for demotion/ removal

493 "And it's grounds for firing." Interfering with Congress' constitutional oversight duty is grounds for prosecution. There should be no going back after crossing that line.
