NYT: Menendez Did Favor for Big Money Donor Melgen
— Ace

Interesting piece, which I think should be read in full, even if you're not following the Menendez story.

It's a story about the very snuggly relationship between high-dollar donors and their politician "friends" and the favors these "friends" do for each other.

Just a little joke there, fellas. Just a joke. Protected as parody. Parodying the L to R identification in newspaper pictures with a deliberately risible rush to judgment.

So calm down.

The short version is that Melgen had bought a contract in the Dominican Republican giving him rights to deliver port-security services to that country; the contract was worth, it's said, up to $500 million. (Actually at another point the figure $50 million per year for 20 years is cited, which, by my math, is a cool billion with a b, daddyo.)

The Dominican Republic didn't want to honor the contract and Melgen dialed up his Very Good Friend Bob Menendez, who in turn called up some of his Friends at State, who in turn exerted their influence to make sure the contract was honored.

So all these Friends act together so that one of their Friends can cash a $500 million contract. (Or a billion.)

Melgen gives an awful lot of money to Democrats. He also throws some money to local (Florida) Republicans, including Mario Rubio and Ilena Ros-Lehtinen.

Earlier today ABCNews (which had the Menendez tip about the prostitutes last May and apparently did nothing with it) broke this related story:

Officials: Agents Raided Office of Menendez Friend After Document Shredding Truck Spotted

Federal agents raided the West Palm Beach eye clinic of a longtime friend and political supporter of Sen. Robert Menendez earlier this week after a document shredding truck was observed at the building, following attempts by FBI agents to question Dr. Salomon Melgen about his relationship with the New Jersey Democrat, according to federal officials familiar with the investigation.

The execution of the search warrant was carried out by a federal health care task force, with agents from both the FBI and the federal Department of Health and Human Services Inspector General's office, which had been investigating suspected Medicare fraud by Melgen's clinics for more than a year, the sources told ABC News.

Oh right, I forgot that: the good Friend Doctor Melgen's clinics were suspected of defrauding Medicare, too.

The raid appeared unrelated to recent allegations regarding Menendez's trips to Melgen's home in the Dominican Republic.

I highlight that because the raid, then, seems connected to this business about favor-trading.

And there's still more in the NYT story. Enter Harry Reid:

In the end, Mr. Menendez won [the 2012 NJ senate contest] with about 58 percent of the vote, partly because of the support he received from Majority PAC, a “super PAC” set up by former aides to Senator Harry Reid of Nevada, the Democratic majority leader.

As the campaign entered its final weeks, the PAC poured $582,500 into New Jersey to support Mr. Menendez’s re-election effort. One of the organization’s biggest donors? Dr. Melgen’s company, which donated $700,000 between June and October.

There's a media angle, too: Melgen set up a Latino-news website, "Voxxi," which praised Menendez to the skies (and also agitated for this contract deal). A former employee says Melgen instructed him to replace positive coverage of Latino politicians like Rubio and instead praise Menendez.

And Menendez did more than just contact State officials behind-the-scenes, by phone. He also questioned State officials at Senate hearings, acting, essentially, as Melgen's mouthpiece:

And at a hearing of the Senate Foreign Relations Subcommittee on the Western Hemisphere last July, he questioned two administration officials — Francisco J. Sánchez, the undersecretary for international trade at the Commerce Department, and Matthew Rooney, the deputy assistant secretary in the Bureau of Western Hemisphere Affairs for the State Department — about why the United States government had not been more aggressive on the issue. The senator said more security was needed given the drug trade on the island.

He does not seem to mention "Dr. Melgen is my 'Friend' who gives me tens of thousands of dollars (at a minimum)."

Now, doing favors for high-dollar donors is (or should be) a criminal violation. But in case you want to know about the underlying argument about the contract: There are claims on both sides. The Dominican government says the contract was gained by a one-sided process, and is essentially corrupt, and against its interests as a nation. Menendez and Melgen argue that this is about the Drug Trade and how Drug Smugglers just don't want Dr. Melgen going all Sonny Crocket on their lucrative Drug Business.

I can't hash that out and I doubt we'd ever have an answer there.

But we do know Menendez intervened on his Friend's behalf, making the US Government, effectively, his Friend's contract attorney.

One last thing: I thought this was in the Times article but now I don't see it. Perhaps I picked it up off Twitter. But the claim was made that the whole Underage Prostitute story was some kind of false claim made by Drug Dealers to get Menendez and Melgen out of the customs-inspection business.

I bring that up as it's an interesting defense -- which you may be hearing more about soon -- and also because maybe it would explain something that sparked my skepticism about the prostitute allegations (as I understand them; see My Caveat at post's end).

Update on My Caveat: @johnnyfriegas was kind enough to translate the emails for me, and they do not contain the second prostitute saying "I know I was underage because it was just before my birthday," which would have been suspicious because the other one says that true.

But she doesn't say that. She just says the first tryst occurred near her birthday.

So I'm less suspicious. Though also not going all-in on the claims of prostitutes.

Bonus Jokes: I felt like I owed Breitbart a picture joke too, so I did one for them.

People are noting these trucks are common enough. Fine, I mean, come on -- I did not imagine Megen scratch-built the world's first shredding truck. I assumed it was a hire, and a hire implies a regular commerce, and regular commerce implies commonness.

But still. Shredding truck.

While being watched by the FBI.

It gets tricky. Everyone has the right to petition their government for redress of grievances, and certainly directly to their elected representatives for such redress. Further, contributions, particularly soft money, are protected political speech. So both of Melgen's actions there are constitutionally protected.

And for a Senator to intercede with an executive branch agency on the behalf of a constituent is well within the duties of a Senator. After all, he's representing him!

The tricky part from a prosecutorial view would likely be finding an explicit quid pro quo, or other explicit pay for services aspect.

the doctor doesn't like to share his lovers he likes. two years ago, he liked me, but after he brought (redacted) it is not the same because he prefers her now.  He wouldn't lend (redacted), but he is annoyed with her because she slept with one of the friends of the doctor and he didn't like that.  his best friend is very important in the United states.  I met him in those activities, and with just looking at him, one realizes that he is important people with a lot of money.  I didn't know he was a senator in the united states.  piter told me that.  that important senator also liked the youngest and the newest.  at first he seemed very serious, because he didn't speak with anyone, but he is just the same as the others and almost has the same taste as the doctor.very refined .  I believe they started to take us more to check us for him.  the first time I saw him was more than three years ago, at the begining of march because it was close to my birthday.  there was another important man there as well.  I remember another occasion a few months later that I also saw him, that time they called us to go , but later they didn't want to let us in.  at the entrance the guards asked for identification ,  which they never do because the doctor's people always seek little girls.  but that time I don't know what happened,  I believe that he wasn't in the house because he was out with his american senator friend, but it was a scandal and they cursed at us a lot,  it even came out on in a radio program named z 101.  a few hours later it was as if nothing and it was then that I saw the important american, that senator in the house of the doctor.


his friend is kind to us,but he also has his favorites.  I know he goes to the new suburb lope de vega with them so no one bothers them , well one told me, but montero always told us that those activities are very private and you couldn't comment on them so we could always go and earn us our 'cualtos'.  I know that senator comes from Miami with the doctor, but I don't know where he lives.


in one of the outings on the yacht was when I realized I had to get out of there, because those people are very important and do what they want with everybody. there was (redacted), who goes to many of the doctor's activities, and began to invent things with the girls and after that practically obligated them to do the same with the doctors friend and he liked that a lot and wanted to take her to another spot which I don't know well.  those girls they supposedly threatened so they wouldn't talk and they also couldn't leave.


look there are many things I prefer not to remember and it is very dificult for me to talk about them.  I entered this world very young to look for "cualtos" , but many things have happened.  there is a lot of hyprocrasy.  they may be al polititical and all, but I saw them many times ding things with those girls and talking about it all that they can't fool me that they are not good people to trust.


I don't want problems with those people , but piter told me that with you I could confide,  that you are going to help us and that nothing is going to happen to the other little girls nor me nor my family.


he said that the one who interests you is the friend that american of the doctor and that I had nothing to do with it , what most worries me is that if they know that I talked to somebody they are going to look for me and I also want that nothing happens to all the girls that still don't know well how is this worldwhere they entered.  I want you to help me take them out,  well i have a sister who is inside.

Shredding trucks are pretty common in Scandinavia too. I worked for a consulting company, and there was a lot of papers produced that may not have been "top secret", but it contained things you really didn't want someone pick up from the garbage, for instance account numbers, passwords, business secrets, etc.. To go through thousands of pages for things like that before throwing it away is just too time consuming, so it's simpler to shred it all instead, just in case.

I personally had two garbage sacks full of documents like that when I cleaned my office, just with my personal working documents.

Shredders that can deal with that amount of paper are expensive, and they can break down. It also takes a lot of time to shred it. So it's simply easier and cheaper to put all papers like that in a locked container, and have a company come by with a truck to shred it all once in a while. The container we had was over 250 gallons in size...

Though in this case the timing is a bit suspicious.

If the Democrats can coverup, gloss-over, and spin Fast and Furious, which resulted in a pile of dead bodies higher than a two-story house, then they can coverup just about anything. NYT suddenly taking an interest in this means Menendez goes under the bus as an effort at damage control. All of this is uncomfortably close to Harry Reid. His PAC connections to Reid will be downplayed, with the sex angle getting all of the attention.
