Did Eric Holder Also Lie... to a Judge?
— Ace

It's very simple: In his warrant application, Holder claimed to be interested in investigating James Rosen as a coconspirator in an espionage case. In addition, he claimed Rosen was a "flight risk," which would justify even closer monitoring (to make sure he wasn't buying plane tickets on Kayak, I suppose).

Now he says he never had any intention of prosecuting Rosen. In other words: He now says he lied when he told the judge these things, in order to secure his license to snoop on Rosen.

Well, which is it? If he never had any intention of prosecuting Rosen, the warrant application is a fraud on the court.

If he did have such an intention... that raises some additional questions.

Posted by: Beefy Meatball at May 30, 2013 11:19 AM (yn6XZ)

41 Yes, this is what I've been saying for the last few days.  Holder thought he was being clever when he told Congress he didn't know nothing about the potential prosecution of journalists, but if that's the case, then clearly he lied to the judge (actually, three judges) when he obtained the search warrant.  The whole justification for not notifying Rosen of the email search was because Rosen was considered a flight risk.  Well, if you have no intention of ever prosecuting Rosen, why are you concerned that he's a flight risk?  It's one or the other.

Another classy line from Marie Antoinette speaking to wealthy donors:

"Just last month for example we saw the failure of common sense legislation to protect our kids from gun violence, legislation by the way that 90 percent of the American people supported. We're seeing a budget stalemate and a sequester resulting in children across the country being turned away from Head Start, and so many seniors losing their meals on wheels, and now there's talk about cutting food stamps," Obama said.

I've been screaming about this for days.  This whole investigation of Rosen was merely a ruse to check out his phone calls and email records, to see who else he was talking to in the administration.

They already had Kim nailed.  They didn't need Rosen.  The Justice Department was merely trying to figure out where to go next.

Holder is guilty of both things, by the way--  it isn't an either/or situation.   He lied to the judge when he claimed he was seriously considering prosecuting Rosen, because he wasn't, but he lied to Congress when he said "I never would consider prosecuting" a reporter, becuase he obviusly did exactly that.

Be careful what you wish for, you who want Holder in jail. I prefer him right where he is - causing problems for his boss. It's over a year until the next election - toss him now and Deval Patrick goes into the slot instead - no one will remember Holder's name. Never help the other side's bench. A scandal-plagued AG is much better than a successful reformer who is then better positioned for 2016.Since Valerie Jarrett controls all the power anyway, it won't make any difference to actual policy. Keep the damaged figurehead AG in place.

Posted by: Nevergiveup at May 30, 2013 11:25 AM (9Bj8R)

69 I have to think lying to the judge would be worse than lying to Congress and it sure looks like Holder did both. With Congress you must a) count on political actors (by definition) growing the stones to actually do something tangible (controversial or not), and b) depend on the MFM to not declare, "Partisan witchhunt!" and immediately rally around the criminal. With a judge, neither applies especially in this case. Team Holder judge-shopped and misrepresented the case to reach an ends. The Courts will not look kindly upon that and they do indeed have godlike killing powers. Moreover, the partisan smear will not have merit.

Holder better hope he only has to worry about Issa's committee.

99 Some believe if Holder gets booted by Obama it will open the floodgates on this administration, but I'm not so sure. I could easily see the MSM praising Obama for "being a true leader" and "making the tough call". ...and then suddenly ALL of Obama's scandals will be declared "behind us" and it'll be, "time to move on". I think we should be hoping Holder stays...at least until the 2014 elections.

136 I recommend reading Orin Kerr's post on Volokh. I'm not 100% convinced but he makes a compelling argument.

Basically: a warrant for evidence is not necessarily related to prosecution and there is good reason in this case to believe it was not intended to be a step toward any prosecution of Rosen.

For Holder to be honest on both fronts, it boils down to Holder showing probable cause that Rosen was engaged in illegal activity and yet had absolutely no desire to prosecute him for it. Orin says it's a valid use of discretion...because resources. Or as I joked, because sequester. It actually is a strong argument. Holder was going after the government leaker. In order to get the evidence allegedly passed to Rosen, Holder had to make a showing of criminality (required by the statute). Like a good lawyer, Holder was able to make that showing in supposedly good faith.

Still, I say an argument can be made - though perhaps not a very strong argument - that the assertion of Rosen's criminality CAN also be a step toward prosecution. And if Holder was considering such a prosecution, then that to me is being involved in "potential prosecution." The problem is that it requires us to speculate as to Holder's intent...because criminality, alleged or not, does not necessarily = potential prosecution. But, unfortunately, we cannot categorically say that the warrant was part of a "potential prosecution."

I know it's terrible legalistic but it's not quite as murky as it sounds if given fair consideration. I agree with Orin that a perjury charge is likely a loser. But ask Holder, under oath, if he believed Rosen was involved in criminal activity, then ask if he had any intent to prosecute. While not strictly at odds, it certainly would look that way to all us plebians.

137 I really think Eric Holder should hire Ricky Henderson as his spokesperson. Then we could get nuggets like this: Ricky asked Eric what Eric discovered when Eric was investigating Eric, and Ricky was told by Eric that Eric investigated Eric, and found that Eric did nothing wrong, that Eric was a good man, just like Ricky, and that Eric was being persecuted cause Eric was black, just like Ricky is black, and that Eric is done investigating Eric and Eric has conclusively found that Eric did nothing wrong. Ricky is completely satisfied with Eric's explanation to Ricky. And all you non-Ricky's should follow Ricky's lead and let Eric be Eric.

They are criminals and cannot be controlled through the Constitution and subsidiary laws. I mean, really. What reasonable expectation does anyone have that any in the administration would follow any inconvenient law? We know beyond a shadow of a doubt that the entire apparatus of the govenment has been twisted to violate the constitutional rights of nearly 140 million Americans - illegally. Each person involved is a felon. Each person involved has violated their oath of office and are in rebellion against the Constitution per Amendment 14 section 3. As usual Kerr ignores the facts of the matter to suit his contrarianism.

Holder et al guilded the lily by claiming he was a flight risk. If they had no intension to prosecute then the flight risk claim was a lie. No if's and's or but's. A fucking lie.

Further as Kraut points out, there has never been a successful prosecution of a journalist for publishing facts from a leak. They know that. This isn't a unique situation.

This was a fishing expedition, and Holder lied to the judge regarding the investigation of Rosen.

She said she'd come back....oh goody. I walked back to the kitchen area and what do I see out the window? My husband rounding the corner with his 'pesticide sprayer'. I went outside laughing my ass off and told him to stay away from the front of the house. I couldn't have scripted that better.... 192 Only reason Holder hasn't been canned yet is that he's and his staff are sitting on top of thousands of documents and information about plenty of scandalous events. A new AG with a new staff would likely have to be TOLD what to be careful with so as to not let anything slip out. In other words, the new guy would have to be just as corrupt as the old guy. That MIGHT be a tall order. For right now it's better and safer for Obama to leave Holder at DOJ with all his fingers plugged into the right holes. No guarantee at all a new guy would know which holes to stick his fingers in.

197 well, as long as we're discussing pricks, this was at Breitbart

In 2007, one Chicago family underwent a nightmare at Northwestern hospital: their newborn son’s circumcision went awry, with a doctor amputating the tip of the boy’s penis. According to a lawyer for the family, Dan Kotin, the doctor missed three safety procedures that should have been followed. According to Kotin, the boy lost “the top 40 percent of the head of his penis.”

The doctor’s attorney argued that this was a predictable complication of circumcision, to which Kotin responded, “If that were a known complication to a circumcision procedure, I suggest to you that nobody would dare have a circumcision done because it would be too risky.”

The jury awarded the family $1.3 million in damages.

I don't think I'm being racist (please correct me if I'm wrong) when I say that if these guys were white guys from CHICAGO, everyone on the planet would assume they were guilty, and they would have gotten nabbed in some scam in the Illinois State Senate back in 03 when they were positioning for power. But Barack gave one golden speech back in 04 and everybody just paved the way for the Great New Hope from the town of scum and villainy. 4 of Illinois' last 7 Governors did TIME. When I look at it simply through the lens of where they come from and not what color they are, this all seems so obvious, and pretty much about as smart from any of the Governor's house back in Illinois could hope to come up with.

Scene: Int. Looks like the Godfather but tacky and 70s and they just think its The Godfather. Picture a fat Ray Liotta behind a Governor's desk that says Eric Holder on it:
"
I WANT DAT GUYS EMAILS. IM THE GOVERNOR. FIGURE OUT A WAY TO GET THEM."

But all beware for we shan't accuse the Golden Child of being a politician.

278 The State Department on Thursday warned Americans about visiting the Egyptian pyramids due to a number of “aggressive” incidents that it says verge on “criminal conduct.” The U.S. Embassy in Cairo said in a release that it “has become aware of an increasing number of incidents at or near the Giza Pyramids.” “U.S. citizens should elevate their situational awareness when traveling to the Pyramids, avoid any late evening or night travel, utilize a recommended or trusted guide, and closely guard valuables,” according to the warning, which the State Department confirmed is an authentic “security warning” issued by the embassy in Cairo. These incidents include angry mobs reportedly “surrounding and pounding” on vehicles and in some cases “attempting to open the vehicle’s doors,” according to the release. Hey obama how's that getting rid of Mubarak working out?

283 Eric Holder is a lying sack of shit.  He's also a crap weasel--but then I'm repeating myself.  If you look at ol' Eric looking out of the corner of his eye at something, he looks like a great big lizard--beady eyed reptile and all that.   But then I'm insulting Gila Monsters when I make the comparison.

285 "...that raises some additional questions."

This is all that needs to be done - ask a whole bunch more questions. Since just about everything the assholes staffing this administration (including the asshole at the head) say is bullshit, if a whole bunch of questions about a whole bunch of different subjects are posed, they inevitably trip up because they can't keep track of which lies were told to whom.

293 This scrunt is way out there. I think she would go to jail in order to protect anyone else involved. I'm thinking any serious threat of jail will scare the shit out of this broad. The thought of missing her 180K +30K bonus lifestyle being replaced by stainless steel toilet/sink with unknown bunk-mate will get her to talk. I think even the thought of doing jail until SCOAMF gives her a pardon in 2017 would be too much for the pampered tyrant.

294 The damming thing about the IRS and the WireTap scandals is: People, big people, deserve, and should, go to prison, not resign in disgrace* just to get new jobs at higher pay. If rocks aren't being smashed over this in the end then *nothing* has been done to protect the American people from future abuses, and you might as well let them keep their jobs and tell them to keep doing what they were doing. America = Despotism.

None of her statements can be used against her in prosecution and she is free to throw the entire administration under the bus. I think they would do it if an orange jumpsuit is in her future.

194"Crispian, interesting, but on Greta last night, she read in section 43 (I believe) of Holder's affidavit some wording that seemed to point 100% intent to prosecute."

Posted by: Schwalbe: The Me-262© at May 30, 2013 04:54 PM (UU0OF)

weft is touching on this too...and it's the legal argument that sticks with me making me not entirely convinced by Kerr. An agressive prosecutor would make the case that the warrant - while not categorically prosecutorial - should be considered evidence of "potential prosecution." Flimsier cases have been pursued by Holder.

Orin is literally saying that a warrant can attribute any manner of criminality, flight risk, etc...but the warrant is to be considered entirely apart from prosecution. Hermetically sealed off from it. Since a warrant need not be done for purposes of prosecution of the targeted individual (but merely to obtain evidence), that is okay. It is powerful logic. Our rebuttal I think is that while they CAN be entirely separable, doesn't mean that they ARE in this case.

298 When Republican officials get accused of serious wrongdoing--no matter how specious the accusation (remember Ed Meese?)--the refrains is: "must resign due to the seriousness of the charge, too controversial to be effective in the job". When Democrats are caught red handed, the refrain is: "everybody does it". What's the over/under on the next defense of Holder's malfeasance being "perjury is racist code for 'uppity black man'"?

Some years ago, I was very peripherally involved in a civil matter.  The attorneys on one side entered sworn depositions from two experts.  While the experts did not disagree with the contents, they had in fact never seen the depositions except as rough drafts.  Instead of being sanctioned, the two attorneys were told they would be well advised not to practice in that particular judge's courtroom again.

So, for those keeping score, it is apparent that one of the following situations is true:

1.  Holder lied to a Judge, in writing, to get a secret warrant approved, or

2.  Holder lied to Congress when he said he 'had no knowledge of . . . and couldn't see himself involved in' abusing journalists as a 'plumber' (leak fixer) . . .

3.  He lied to both, casually and with apparent contempt.
