Conflict of Interest? What's That?
— Open Blogger

Yesterday I wrote about the State of California's lawfare against the Center For Medical Progress to punish them for cutting into Planned Parenthood's business, which consists mainly of collecting money from frightened young girls.

The article I quoted had this bit:

The California Department of Justice, under the auspices of now-Senator Kamala Harris, raided Daleiden’s home for footage in April 2016

Senator Kamala Harris. That's Kamala "possible frontrunning Democratic candidate for president in 2020" Harris. But there's more to the story:

Officials from California Attorney General and Kamala Harris office and Planned Parenthood collaborated to draft legislation targeting the pro-life activist whose undercover videos showed officials for the nation’s largest abortion provider discussing the sale of fetal body parts, emails show.

The emails depict conversations between the state agency and Planned Parenthood over AB 1671, which would amend the penal code to make secretly recording and disseminating communications with health care providers a crime. Gov. Jerry Brown has until the end of the month to sign or veto the bill.

AB 1671 is a response to the Center for Medical Progress’ undercover video series spearheaded by David Daleiden.

So if they were honest, they would just call AB 1671 the "Shut Up About Planned Parenthood's Chop Shops and F* You, Center For Medical Progress In Particular" Act.

But can they get away with this?

Ronald D. Rotunda, a professor of jurisprudence at Chapman University, said the emails show Ms. Harris is a “tool of Planned Parenthood.” He said it is not uncommon for the attorney general to play a role in the legislative process, but added that Ms. Harris in this case was “working with Planned Parenthood to protect it from criminal prosecution.”

I rate this statement: true.

Also, this one.

To describe Kamala Harris' relationship with Planned Parenthood as 'incestuous' gives incest a bad name.

And it gets even better: This latest witch hunt against Planned Parenthood's enemies is led by California's Attorney General, Inspector Javert Xavier Becerra, who is himself a recipient of campaign contributions from PP. It's such a dog's breakfast of conflict-of-interest that it is difficult to imagine it not getting immediately tossed.

But things never seem to work out that way. CMP is probably going to have to appeal a bunch of times, and spend a lot of money doing so. Which, no doubt, is exactly Becerra's intention.

I wish there was *one* crack investigative reporter from the MSM (you know, the kind they all imagine themselves to be), with the guts to ask "Mr. Becerra, isn't this prosecution a conflict of interest for you since you're a recipient of donations from Planned Parenthood? In fact, isn't that pretty much the very definition of 'conflict of interest?'"

Yeah, I know.

One thing everybody needs to know about the pro-life movement:

They're never going to give up.

They've existed for years without deep-pocket patrons, oftentimes standing and protesting and praying outside of abortion clinics in the freezing rain. 10s of thousands march on Washington every January, 100s of thousands, despite the near-total lack of media coverage. Every year since the passage of Roe v. Wade.

God bless them.

The telltale signs of fascism are the selective favor paid toward allies of those in power, to the point where Rule of Law is rendered moot. There is no equal protection under the law, there is no equal application of its sanctions. Law enforcement is based on your status within the state and its allies. These people are fascists. I would very much like to drive this point home, and have it somehow get through the thick heads of American voters/citizens.

No. The Colorado law doesn't say "thou shalt not block..". It says "thou shalt not protest..." Just the mere fact of you standing there with a sign watching the traffic go in and out of the building is a crime.

My point is, this is a bullshit exception to 1st amendment case law that progressives have succeeded in carving out for themselves. It benefits them and nobody else. This AB 1671 looks like another bullshit exception that, just like the Colorado law, is of benefit chiefly to progressives. So that is why I'm afraid it may hold up on appeal.

If any particular physician demands a privacy waiver for himself,  as I presume would be his right, I don't have to be his patient and I'd take that as a warning sign.

But as a matter of course there is nothing special about conversations with health care providers which  isn't about some protected third party that should ban publication.

91 Vic, you have it slightly wrong. Just slightly over-simplified, the teachers' union runs CA. Pretty close. Via Dem legislators, of course. Govt. employee unions, taken together, run the state. A few years back, some jaw-dropping stories came out about lobbyists storming into legislators' offices, and dressing them down - like DIs at Marine boot camp - in front of their staffs. THAT is how collapsed CA politix are. Meaning, that's how ignorant, lazy, and irresponsible CA voters are. Note that most of the most insane, indefensible, unconstitutional nonsense that has been adopted in CA in the last 6 or so years has been via vote of voters (propositions) - not legislative action.

97 So let's be honest. The reason Planned Murderhood is tolerated - in fact, encouraged - in this benighted country is because it provides a quick, easy - one might even say "final" - solution for Our Betters when Muffy gets knocked up by Trayvon or Pablo. Or when Charlington Chinwaddle IV gets an unfortunate hankering for that sort of prole. Or when that cute, big-boobed aide or PA inconveniently forgets her pill. PP exists to erase the sexual mistakes of the ruling class. No more, no less. Posted by: Mary Poppins' Practically Perfect Piercing at March 30, 2017 01:19 PM (X6fMO) You're a bit over the top, but correct. 99 73  No.

The law was intended to keep them at a distance that would assure they were not blocking access because initially before the law was passed that is what the protestors did.

101 Conflict of interest is like when an official who is supposed to be impartial is involved in a situation that involves the appearance of impropriety in that regard. For example, suppose one held a high political office and also ran an organization that accepted large donations from foreign powers while appearing to do favors for that power. That would be a conflict of interest. So to give a real life instance of that, if Trump let a Russian stay at one of his hotels and later became President, that would fulfill all criteria necessary to constitute a conflict of interest. Capitalists and conservatives are so sleazy. They lack a moral compass.

What's sad is that a group of black pastors *did* call a news conference outside of the National Portrait Gallery to express their horror at Sanger's inclusion in a Civil Rights exhibit. They did this *after* writing the museum to protest -- and had been ignored. And IIRC, only pro-life outlets reported on it.

251 There will be a very, very special wing of Hell for these people. The left doesn't believe in Hell. Or in the concept of right-and-wrong. Or in personal responsibility. The ONLY thing the left believes in is *power*. They can throw any belief system completely overboard at a moment's notice so long as doing so tightens their grip on *power*. How else can one explain their alleged support of "women's rights" while simultaneously extolling the virtues of Islam?

253 Oregon Muse, thank you for writing articles about this, consistently. Thank you for taking a stand about abortion, and the evil that Planned Parenthood does each and every day. That's yeoman's work, and you are faithful doing it.

254 246 Kamala is a common Sanskrit name meaning The Lotus. Heh. Inspector Cleuseau got 'Tanya the Lotus Eater' when he stumbled into the whore house. "Another round-eye bites the dust" https://www.youtube.com/watch?v=Zb1HBLMMIzk

255 If abortion were left to the fathers to decide you better bet it would be a capital crime. /kidding only slightly. Why when murder of an innocent human life is left to the mother is it still legal?

256 70 Has there never been a father who filed a wrongful death civil suit against a mother who aborted his child, and the abortionist? Posted by: TexasDan < NYT has some from around 1988, the fathers had no wins. Win here, though not in the same vein or recent: (bottom link on page) http://www.lifenews.com/2015/06/12 Baby born alive after botched abortion, mom sues for hardship of raising unwanted child to 18, abortion provider turns around and sues father for not using effective contraception. They settled with mother. Dads have all the fail. They want the baby, no power. They don't want the baby, no power and must pay for it. Men should really band together to fund effective male birth control. Or maybe mass sterilization is what the elite are hoping gets pushed for. Was that Gattica?

257 I'm not worried about this. The statute will be struck down, and the prosecution halted, once the 9th Circuit judges apply the same "let's go behind the text of the law to see why these guys *really* passed it" test to this atrocity as they did to Trump's Muslim ban.

259 I think the grave-robbing Attorney General noticed the Senator from Big Baby's promotion, and he's hoping to ride the Ghoul Train all the way to the governorship like she did to the Senate. Donner Party Democrats.
