Anthony Weiner Retains Counsel...Not To Defend Himself But To Advise Him About "What Civil Or Criminal Actions Should Be Taken"

Ok.

A spokesman for Rep. Anthony Weiner, New York Democrat, told The Daily Caller the Congressman’s team has “retained counsel” and is exploring the “proper next steps” after his official Twitter account posted a picture of a man’s erect penis underneath gray boxer shorts. The internet-driven scandal has come to be known online as “#Weinergate,” a pun on the Congressman’s last name.

“We’ve retained counsel to explore the proper next steps and to advise us on what civil or criminal actions should be taken,” Weiner spokesman Dave Arnold said in an email. “This was a prank. We are loath to treat it as more, but we are relying on professional advice.”

So in Wiener's World hacking multiple social media platforms of a sitting US Congressman in what's clearly an attempt to damage his reputation and limit his participation in debates of national importance is just a "prank"?

Most people would call it something else...a crime.

I'm not a high priced NYC or DC lawyer but allow me to offer some advice. Call the FBI.

Now in an effort to help out the Congressman in his battle to clear his name, here's how to report a cyber crime.

You're welcome.

On second thought, perhaps I'm being too hard on Congressman Weiner. I mean every PSA I've ever seen about crimes always urges people that if you are the victim of a crime or see one committed you should immediately call the cops retain counsel to help you consider your options.

I bet the idiot who illegally accessed Palin's emails wishes he'd picked on Weiner instead. She called the cops but apparently Weiner is more forgiving of being violated.

I think it's wonderful that Weiner is such a let bygones be bygones kind of guy but doesn't he owe it to the Comley Coed to bring the perpetrators of this 'prank' to justice for the anguish they've caused her?

If liberals are so sure this is an Andrew Breitbart or conservative hit job, shouldn't they be hounding Weiner to call the FBI? I mean if they could send a conservative to jail for something like this, it would be a big plus for them, right? I wonder why they aren't. Oh, right.

Weiner’s office did not answer specific questions about the photograph, whether he has contacted authorities or the Seattle woman who received the photograph.

53 As to this being a distraction to his work, I disagree.  Isn't he involved in legislation to protect campus students from sexual harassment and internet predators or something?  This seems to me to be a gift!  A first hand experience of the very thing he is working on as a congressman.  If anything, this entire episode should only spur on these legislative efforts, and act as a rallying cry to enact and enforce his own legislation.

By extension, if this were truly a "prank", then Weiner would have to know instantly who was responsible, and there would be NO reason for Weiner to protect that individual.   He wouldn't necessarily have to press criminal charges, but he would have the guy fired on the spot, and there would be no reason to try and protect his identity.

I think Weiner's main goal here is to prevent any kind of independent or (worse) police investigation into this incident, because I think it probably wouldn't be too difficult to prove conclusively what happened here.

Again, I wonder if there is some mechanism for a Congressional House investigation into this serious security breach of a sitting member's personal social media account.

I don't know about policy WRT actual "caching" of data, but server logs will record and timestamp (usually) the request of every. single. file. made from a client - even requests that the Twitter server cannot serve (like a file it doesn't have).

Server logs are stored and typically archived for several months if not indefinitely depending on the resources of the business.

So all of these servers (from Twitter to Facebook to yFrog) will have logs of forensic evidence. There may even be third party proxies that have some records. Date, time, file size, IP, client, and more will be recorded and stored.

1) At no point does Weiner explicitly state that is not his wiener. He states the pic doesn't belong to him and he didn't take it but NOT that it isn't him.

2) The Daily caller piece says this

Weiner’s office did not answer specific questions about the photograph, whether he has contacted authorities or the Seattle woman who received the photograph. He has said that his Facebook was hacked and if his Twitter had the same password, that too could be vulnerable.

Both denying the pic was him and stating his passwords were the same would go along way towards proving a hack. Why doesn't Weiner do this simple thing?

Twitter damn well better. It really isn't about what Weiner wants at this point. A powerful Congressman has just impugned its security. Now, how is a social networking site going to remain a viable, trustworthy organization if it leaves that red flag out there? Twitter simply cannot walk away from this charge. It's viability as a business is at stake unless it can categorically deny that it was not hacked. I don't think he committed a crime and I'm against calling in the police for the sole reason that I don't think one occurred.  We're bringing it up because, if one actually occurred, he would.

He doesn't know that all that happened was a lewd message being sent.  For all he knows, they stole his personal information.  That would cause him to be in very deep sh-t for reasons that have nothing to do with us.  It's why, if this actually happened, he'd go to the police in a second.

For the record, though, lying under oath (if you're anybody other than President Clinton) absolutely is a big deal.  There are no sex exceptions.  There's no law that states "you have to tell the truth and nothing but the truth...except if the question has anything to do with sex."  He got away with it, but don't walk into a courtroom and think anybody else is going to give you a pass for that.  While you might not like it, if you ponder it, you'll be able to come up with a number of reasons why installing a rule that "yes, you can lie under oath if the question or the answer involves sex" would be a very, very bad idea.

Reagan didn't fuck around (and I'm aware of no serious accusation that he did), at least not when he was married.  He was active after the divorce, but Jane Wyman stated openly that the divorce was because he was spending too much time in politics (and if you want to be more cynical, his career was on the decline while her's was taking off).

The guy entered his house one day only to find Jane Wyman telling him "get out, you bore me," and that was it.  That's why she didn't say much while he President.  She felt guilty over how she treated him.

444 Let's not forget that Weiner is allowing his supporters and other Left-wing partisans to demonize Breitbart and all conservatives as being behind this "hacking," as well as leaving the college student who was the intended recipient of the tweeted picture to have to deal with the attention. But, I guess Jordan is fine with all of that, as evidenced by his attempts to portray those on the Right as the bad guys because we (i.e., U.S. citizens, Twitter users, Facebook users, Twitter investors, etc.) are paying attention to this situation and want answers to whether the account of an elected official was really hacked. Because if it was, it may impact us as citizens (e.g., public official who could be blackmailed) and as users of social media beyond simply a sole Democrat politican taking a PR hit and having his political career hurt. If people like Jordan think Weiner is lying, as he wrote earlier, then he should focus his attention and criticism on Weiner, not those of us that want the truth.

I have no freakin' idea who you are or your opinions on this site so if you've expressed opinions that should make me think that you're a rock-solid conservative then good for you. I'm just not aware of them. I should say that you do like to utilize the favorite debating tactics of liberals -- e.g., resorting to personal insults and challenging the intellect of others that disagree with you. Fair enough. I agree with you on the details regarding law enforcement being involving with investigating his personal sexual behavior, but if he's claiming his account was hacked illegally then law enforcement at some level should be involved, as it was when Obama's Twitter account was hacked last year.

Let's assume for the sake of argument that Weiner is lying as he sent the pic and there was no hacking, which is what I think the available evidence indicates occurred. Personally, here's to hoping that Twitter releases a statement to calm users of their service in which they say something like, "It is our belief that Rep. Weiner's account was not accessed illegally as the IP address of whom sent the picture was the same as it was for the regular user of the account." Then Weiner can come up with some explanation or excuse to save his political future (and perhaps marriage), Twitter users and investors won't lose faith in the service, and the Left can stop blaming Breitbart and others on the Right for an action they had nothing to do with. Of course, this is assuming that the story Weiner told is simply untrue and no one on the Right had anything to do with it, which, once again, is what I think the available evidence indicates occurred.
