An Observation About Hobby Lobby & the Left
— Ace

David French writes:

[The left's hysterical reaction is] instructive because it demonstrates the extent to which the Left is emotionally and ideologically committed to the power of the regulatory state. For some time, the Left has been selling the public and the courts on the notion that somehow the act of forming a corporation and opening for business operates as an effective waiver of your most basic liberties, including free speech, free exercise of religion, and virtually the entire panoply of property rights. In effect, your business is not “your” business at all, but instead all aspects of its operations exist at the whim of the state, and if the state wants to draft you into its child-killing abortion crusade —-- or wants to muzzle you during political campaigns -- then you best salute and fall in line.

It occurs to me that the Left is attempting to create a system wherein there are two different classes of citizenship, one fully possessed of its right to speak and act politically, the other whose rights in this regard are sharply curtailed.

That's obvious, that's not the interesting part.

Here's the interesting part, I think: The Left, were it to have its way, would forbid anyone who is not primarily in the business of politics (or working for the government or university) from exercising their full political rights.

If you work in any other industry, your rights are substantially reduced.

Think how much this proposed rule would benefit the Left, were it fully accepted. (It is 85% accepted at the moment.)

The only people who would be permitted to speak on political issues, or at in accordance with their social/cultural/religious/political principles, would be the Political Class Itself, which is of course largely "progressive."

Shopkeeper? Nope, you're not a professional of the political class. Shut up. You have no right to run your business as your conscience dictates.

Baker? You're not a professional in the political class. Shut up and bake the cake.

And so on. By choosing an economically-productive trade which is not politics, you have ceded most of your rights in the political sphere, per this line of thinking.

The people who retain their full rights are the artists, the academics, the media class, the union officials, the teachers and other civil servants, and all the various functionaries of the permanent DC lobbying/think tank class.

This seems to me to be very congruent with the Left's conception of a cadre of people who will Do all the thinking for the rest of the country -- the revolutionary vanguard -- and the rest of the people who will actually generate the economic surpluses that the vanguard will then divvy up.

The Left continues to conceive of their idea of a Utopia in which some -- they themselves -- are the the thinkers, the plotters, the dreamers and the schemers -- and everyone else is merely a doer, a revenue-generating economic unit which is expected to follow the orders issued to them by the Thinking Class.

15 Yup, though social media is bringing us to that point anyway. Increasingly, the only people able to express strong political opinions are people ... in the business of expressing strong political opinions. A regular person with a regular job or business -- you can't afford to say anything controversial on Facebook or Twitter cause the ProgMob might decide to destroy you, destroy your reputation, and render you penniless and unemployable.

Almost, but not quite. Full rights go to lawyers. Partial rights go to those you mention. But only if they're licensed by the government. So, newspapermen -- journalists. Bloggers -- non-journalists. And they'll stick with that until they figure how to carve out Fox News and conservative opinion journalists.

24 True and corporate America is fully cooperating in this. When I retiring in April, I had just been assigned over 40 hours of mandatory training designed around compliance and diversity. For all of that training, there were certificates to be signed and turned in stating that I had been informed, received training, and understood my corporate responsibilities and that failure to follow any of those guidelines was grounds for termination. Not having to do that training was one of the sweetest rewards of making my decision to leave.

Posted by: Sherry McEvil, We Be Bossy at June 30, 2014 12:30 PM (kXoT0)

25 You could, of course swap into the argument the "establishment of an organization representing worker's interests" for "forming a corporation and opening for business". Except you'd have to change the preference cascade on every point regarding free speech, willingness to go along, and the need to salute when one's already implicitly saluting.

36 I'm reminded of the Batman storyline No Man's Land which was incorporated into The Dark Knight Rises. One aspect of the story in the comics was that gangs running Gotham would find reasons to keep around people in a no power environment. Mechanic? Fix this bike and we have a use for you. Seamstress? Fix this coat and we have a use for you. Social worker? We have a use for you (cut to dead body wearing a Keep Out sign) The point? 87 One of the very few things I admire about the rabid left is that they never ever retreat on any of their most cherished principles, ever, they only advance. Even if their principle is full of incorrect facts and folly. Thus any setback is treated like a devastating blow, which they then use as a battle cry to rally the foot soldiers and eventually the LIV. It will be interesting to see how they use these findings to gin up the base in the fall.

91 Here is a semi-OT question I just dropped in the last thread:

"Can Congress pass legislation that effectively overturns Marbury v. Madison (which gave our Black Robed Masters authority to decide what "constitutional" means), and if so, how would that affect the coming battles over implementation of Il Douche-care?"

I was an attorney for 18 years and retired recently, and wasn't a con law scholar, so I'm interested in the Horde's take.

92 Ginsburg's dissent shows her one-way carnival mirror view on this, citing "workers who sustain" corporations. In leftist union-hack thinking - there is no "private enterprise" - a business is the property of the workers and exists for their benefit. Earth to Ruth - Why should anyone be a boss/sef then ? Just be a worker/owner. It worked out well for the Twentieth Century Motor Company.

97 Speech and the freedom thereof asserts that you have a right to an increment of power. When you deal with the righteous who believe they have moral authority then your speech is a threat to their power and their moral authority. The idea that we have free speech implies that we all should have various increments of power. That is anemtha to those who seek to rule over others for our own good. After all, any attempt to assert ourselves in contradiction is seen as an attempt to self-harm, in their minds. The enlightened believe they are stopping us and others from causing harm to self or others. This is what the noble zealot believes. The opposite is to believe that persons contain in them their own power and have the innate right to exercise that power to the degree that they consider. So long as that is true the masses represent the opportunity for any moral discordance. Instead of working w this discordance (democracy, capitalism) they seek to eliminate it. This is the heart and justification of all totalitarians.

Yet again- Atlas Shrugged and 1984 were not intended to be "How to" manuals. Elections, donating money, and TEA Parties aren't going to cut it anymore. Election fraud is rampant. The TEA Parties are a joke now and mostly as bad at the government they purport to be against. Donating money directly? To which of the 6 dozen candidate for each seat? Our money is diluted while the GOP and Democrats is consolidated behind their hand-picked lackeys. The Left has the media, K- PhD education, all government and other public sector agencies, unions, about 52% of the population, and the majority of minority groups and people from age 35 and down in lock step. Think I'm wrong? How many people depend on a government check today? I'm not just talking about EBT cards and the like. Social Security, Medicare, Medicaid, Obamacare, corporate and farm subsidies, rent controls,... Which of them are going to give up their checks permanently? IMO we have two choices left: 1. Here I was withering away, never knowing that the Meaning To My Life could be found in the third row of your Environmental Feminism 302 class (when not occupying your Mother's basement). Thank you, Mr. Twenty Two Year Old Liberal. Now if it's not too much trouble, could you step away from Grand Theft Auto V long enough to inform me which route I should take home after leaving work? Surely such a trivial task is no match for someone with your superior judgement. 199 Let us postulate something here.

It is an article of faith among the modern institutional left that government's primary role is to generously and constantly hand out Moar Free Shit.

The list of stuff the government now hands out for free is endless.

Free food. Free housing. Free transit passes. Free medical care. Free education. Free electricity. Free smartphones with data plans, for Pete's sake.

Why in the world would they simply not add "free birth control" to the long list of government-distributed Free Shit? Birth control is _ridiculously dirt cheap_.  And, only a subset of the population needs and/or wants it. Every single person who wants birth control in the country could be provided it, by the government, at an incredibly low cost. It would be a rounding error on top of the existing yearly bill for Free Shit. A fraction of a fraction of a percent.

Why then this absolutely obsessive drive by the left to force religious organizations to perform this one comparatively small symbolic act of Free Shit distribution?

Simple enough why. It's because self-described progressive leftists pride themselves on having "thrown off the yoke of backward, superstitious religious thinking," but in reality, they haven't done any such thing.

All they have done is to perform a substitution of a new god figure, Government, for the old religious God figure.

And God-vernment is as jealous a god as the human race has ever witnessed. When God-vernment says what translates to "Thou shalt have no other gods before me," listen up, because God-vernment bloody well MEANS IT.

That's what all this comes down to. Forced submission. Before the temple of God-vernment, every knee must bow and every tongue must confess. Especially true of bitter-clinging believers in those "backward, superstitious" religious faiths which preceded the advent of God-verment.

Who _will_ ultimately be forced to conforim their own doctrines and suborn their own beliefs to those of God-vernment. Or else.

They are clean, and organized in a way that makes finding what you're looking for very easy.

They have decent prices on things like arts and crafts supplies.

They also have a lot of 'home decor' things, like specialty tables, sofas and chairs.

Kenmore appliances are usually just OEM manufactured for Sears by outfits like Whirlpool. You can even figure out from the Sears model number who the actual manufacturer is, with a bit of digging on the Internet.

And, it's typically just a slightly reworked version of an appliance which the OEM sell elsewhere under their own label, or under another department store label. So once you have that information in hand, you can run down compatible parts with relative ease.

What bugs me is not having easy access to service manuals. Appliances are sometimes hard to take apart and put back together without those. And, if it has a goddamn microprocessor in it, that complicates life further still.

I'm actually okay with stripping ALL nonprofits, religious and otherwise, of their non-profit status. Since the government have demonstrated that they have a thumb on the scales to their own benefit when it comes to determining who is and is not a "nonprofit". Let's just get rid of the category.

See also: the absolutely rampant illegal electioneering that goes on in many black churches, most recently in the Cochran-McDaniel runoff.

I don't care if a church openly instructs its flock from the pulpit who to vote for, I don't care if they hand out political literature and ballot guides in the church, I don't care if they use church buses to drive people to the polls. I want them to HONESTLY PAY TAXES THE WAY I DO if they're doing that crap. Which they are doing.

There's nothing stopping people from forming their own branch of mormonism. Why do they need to cram it down the throats of all the other mormons?

It was only a matter of time before the government took that power and expanded it into what we're seeing now. Do I agree with those old businesses that refused to serve what sometimes was a significant part of their potential customer base? Not really but when you allow the government to make those types of decisions you're looking at a lot of unforeseen consequences down the road.

-----------------

"Lines of authority" are important to the LDS faith.    As a result, starting a splinter group isn't as easy as it is for, say, mainstream Protestantism.  Sure, you might be able to get a small, tight-knit community like the polygamist groups.  But nothing larger than that is going to catch on.  The belief that the successive leaders of the LDS Church have all been prophets of God makes it more difficult to start a successful splinter group than it does in most Christian religions.  You need to convince people that while Joseph Smith and successive leaders were prophets of God, the current guy leading the church isn't.  That can be a bit tricky.

That's where you're wrong.

You see, Birth Control is a Civil Right.

Like Water.

Note what is happening with Detroit and the UN- factions in the city are asking the UN to pay the water bill of deadbeats, because water is a civil right. If the government doesn't pay for Birth Control, their Civil Right to spread diseases and f*ck like animals and not be "punished" with children is being denied.

The state is to supply everything for your entire life. If you are denied something, it is a violation of your Civil Rights.

Did you not get the memo?

419 An artist would only be part of the elite class if the art itself was lefty-approved. Any artist that produced art that could be interpreted as "right wing" would be vilified, mocked and possibly eventually censured. One of the drivers of the Renaissance was the fact that artists were rebelling against having to create within boundaries approved only by the Church. Anything else was heretic. Leftists are trying to take us backwards. But you knew that.

@345 What does excommunicated mean in the Mormon church?

In Catholicism you are still welcome (in fact still expected) to attend mass, though you can't take communion until you get squared away. Only a vitandus writ (which seldom happens anymore) will get you kicked out altogether.

-----------------------------------

AFAIK, pretty much the same in the LDS church.  Things like offering prayers in Sunday School are also prohibited.  If an individual is lacking remorse, and insisting that they're in the right despite the disciplinary action by the Church, then I suspect that they might be asked not to attend for a period of time in order to avoid disrupting meetings.  For instance, having someone who was a die-hard Ordain Women supporter get up on the first Sunday of the month (which is the usual Sunday for Testimony meetings, which are a form of faith-affirming open-mic meeting) and start to opine on that might cause problems.  But iirc there's no further level of disciplinary action beyond Excommunication.

Posted by: AmishDude at June 30, 2014 07:03 PM (T0NGe) I was under the impression that Obamacare mandated that all birth control must be provided at no charge, including OTC. All one needed was a script. When I was still working in health care, we used to have many a patient ask for a script for OTC meds such as Ibuprofen so their insurance would pay for it. Eventually the insurance companies figured it out and began removing OTC drugs from their formularies as soon as they became OTC. That is why I am thinking Obamacare actually spells out exactly what must be covered. The writers of that monstrosity wanted to make sure everything they could possible get covered was.

516 Have we yet reached the point where "conservatives" will stop writing essays on the sociological aspects of Choom Boy's actions -- and bewail the Bad Optics of being toooooo critical of him -- and start clamoring for Articles of Impeachment?

Limbaugh apparently said President Historic First© should be removed from office for the IRS scandals. Today's public admission of treason and several previous actions strike me as being far more impeachment-worthy.

Enough with the endless yak-yak-yak of the Chattering "Republicans." How 'bout a little action before it's too damn late?

The baby is all "Babity babbledy gurgledy bada goo"...with an attitude.

And the Bulldog is like....'Yawn, whatever man'.

And the conservative adults in the room just roll their eyes.

522 The danger is in what has become an unequal, unconstitutional fourth branch of the government. Without the administrative state there woould be no vehicle by which to usurp a businesses rights or more correctly those who open that venture.

Via the cabinet offices the worst offenses against our rights, the most dastardly offenses against a constitutional republic are carried out.

It is about time we rid ourselves, perhaps via the courts, but perhaps most correctly and effectively by using the power of the purse which Congress, our Congress has as a constitutional power, but which the established politicians have incorrectly used to ensure their own longevity, and in the process usurp our rights and privileges. It is about time to starve the best and if in the process some in Congress get eaten- so be it.

At the rate things are going...it might be the Dems who start clamoring for Impeachment.

Barky is destroying the Rule of Law.

Liberals depend on using the Law, to force people to do what they want.

Some of them are starting to figure this out.

Nothing would delight the Dems more, than Republicans filing Articles of Impeachment.

They...would...love it.

537 Here's a whack at a dead thread. I have long thought that one of the most perverse effects of PC language control is to make the very issue of who we let in the country, from what countries, in what proportion to be off limits from public discourse (because "Racism!"). And so, who can speak of these things, that must be decided by someone? The ruling apparatchik class that's who, and only the apparats. No one else can even debate it, or speak about it seriously, because Racism! Actual, legal disenfranchisement could not be more effective at silencing dissent.

539 the left is about coercion and the use of force. the left believes so strongly that they are morally "right," they feel that using any means necessary is acceptable. gone are the days where debate and deliberation was the way we, a civilized society, resolved our differences. instead, the left wants to stop anyone that doesn't agree with them from talking. the left is so disengaged from logic they will only be happy if people on the right shut up and or just die. they are fascists and want absolute power to control those that disagree with them.

542 This theory fits like a glove with the Ruling Class vs Country Class paradigm popularized by Angelo Codevilla. He's written about it a few times in the past four or five years. Except his emphasis is that while the GOP establishment used to represent the interests of the Country Class, it has sold the Country Class out and is now part of the Ruling Class. That leaves the Country Class - which he believes is a majority of the country - "orphaned" and without adequate representation. He's given up on the GOP.

543 Ref the Left and the Right and their relative points-of-view: Essentially, the Right (no I do NOT mean the GOP!) believes that each individual owns himself. The Left believes that each individual belongs to The State. Everything else derives from that.
